We are a wireless Internet supplier and was thinking of starting a online video store on our personal private network Meaning that we are only going to supply this service to our existing clients on our private wireless intranet.We have no intention to broadcast this on the public Internet. My question is as follow what is the legal aspect of this.Currently we are a license Wisp. Does this falls under the same license. If anybody can give me a answer to this question it would be much appreciated.:)

You'd still need distribution licenses afaik which are a schlep and expensive. Or you go down the illegal route - not advisable...

Hi, welcome to the forum.

I am assuming you mean you want to serve digital downloads/streaming? If so, then no you cannot use a wisp licence. I am not 100% sure, but I think you would need to contact ICASA as you essentially become a broadcaster.

We dealt with this issue before for an international client.

You will first need to identify the movies you wish to distribute and then contact the copyright holders (WB, etc.).

They have set contracts in place for distributors. The lower the number of copies of movies you will serve to clients, the more expensive will your agreement become. In some instances we found you can distribute 1000 copies of one movie per month and it will cost you around $4000-$8000 for the contract for 1 video for 1 month.

Also, the manner in which you intend to serve the movie will also be investigated for security purposes. Clients should not be able to download or store movies to their computers. Your license increase tremendously if you want them to do this.

There are a lot of red-tape and it will cost you a lot of money if you are still small and have limited clients.

The bigger you get, the more clients, the more titles and the more streams your agreement with these companies will become more lucrative.

Hi There,
Just broadcasting is going to infringe on the distributors set up in this country so you could have the likes of Primedia (Ster Kinekor) coming after you.

I would suggest you contact a lawyer for their opinion but I suspect to do it is going to be very expensive. You can get legal advice online here

Not worth the hassle and bother. Primedia have this idea sewn up tight in this country and you cannot fart without their permission
