Oscar Pistorius: The Appeal

His sentence has been extended by the way to 13 years... by the Supreme Court of Appeal this morning. NPA wins - but they don't get the 15 years they wanted.
 
Ouch, wonder if Oscar is going to appeal that..., or if he can afford to.

That sounds better. But, that means he only needs to serve 4.33 years before being able to get parole. How long has he served now?

Though he was released from prison after only 10 months of the original five-year sentence, how is the prison portion of the sentence actually worked out?

I think that was 10 months plus 2 as "time served" not sure, as his original sentence was 3 years iirc.

Not according to the news article posted in the other thread.

North Gauteng High Court Judge Thokozile Masipa initially sentenced Pistorius to five years for culpable homicide in 2014.

Pistorius served only 10 months of the five-year sentence in prison before being released and put under house arrest.

Under South African law, the double amputee was eligible for release under "correctional supervision" having served a sixth of his sentence.

I wonder if this holds true for the new sentence?

1/6 of 15 years is only 2½ years which would still seem lenient.

To summarize for those who didn't read it yet:

At the time Judge Masipa warned Pistorius that to deviate from the 15 years mandatory sentence, the court must find mitigating circumstances.

Judge Masipa, however, did find mitigating factors, such as that Pistorius did believe there was an intruder in his house and that he was vulnerable without his prosthetics.

Judge Masipa at the time also noted that Pistorius tried to ask Reeva’s parents, June and Barry Steenkamp, for their forgiveness. This, she said demonstrated that he was genuinely remorseful for what he had done.

But Justice Seriti said he found it difficult to accept that Pistorius was genuinely remorseful. “He failed to explain why he fired the fatal shots… He failed to take the court fully into his confidence. To my mind the attempt by the respondent to apologise to the deceased’s family does not demonstrate any genuine remorse on his part.”

The justice said Pistorius, before being sentenced for the second time, had the opportunity to play open cards, yet he did not.

“It is clear that he is unable to appreciate the crime he has committed... He does not appreciate the gravity of his actions.”

Justice Seriti was of the opinion that Judge Masipa over emphasised Pistorius’s personal circumstances when she sentenced him. He said she seemed to have given rehabilitation undue weight, as against the other purposes of punishment of prevention, deterrence and retribution.

“I am of the view that there are no substantial and compelling circumstances which can justify the departure from the prescribed minimum sentence of 15 years for murder in the circumstances,” he said.

problem is he wont, he will just continue to appeal as he got the funds and the time to keep going....
same story with any rich guy, they can keep the courts and lawyers busy till time immemorial.

justice cost money, and if you have enough you can make a joke of the legal system.
 
Hey Oscar can your body not wither like those legs for Fks-sake give us a break less we hear about this 1/2 man the better.

Oscar Pistorius approaches ConCourt to appeal 13-year murder sentence

Johannesburg – Former Paralympian Oscar Pistorius has filed papers to the Constitutional Court appealing his 13-year sentence for murder.

The papers were filed on Monday, News24 has learnt.

Last month the Supreme Court of Appeal (SCA) in Bloemfontein increased his sentence to 13 years and five months in prison for the 2013 murder of his girlfriend Reeva Steenkamp.
