Outstanding Car Payment

In December I missed a payment on my car due to clients not paying me in time, so I made arrangements to pay as soon as the invoice I made out paid me.

Going on strong (only getting paid last week Friday) I made an arrangement on the 12th of January to pay R1000 (the agent said I should pay in any amount and arranged for that) and that I'm still outstanding R1400 odd on the repayment and should pay that ASAP. My payment date is the 15th of every month, so I told him that since it might be after the 15th, if I can't come up with the rest of the payment by 27th of January, I'll sell the car (since I don't need it and can get a bit more than the settlement amount)

Today I received a statement that said I owe R5399 MORE that what was on the statement on November (balance brought forward) and according to their system, it's actually incorrect... and then the shocker I should pay the arrears by no later than tomorrow or they'll hand me over to debt collection/legal team.

WTF? Where is my 30 day notice? I haven't missed 3 payments yet?! Where is my final demand/chance to go for debt counselling?

FYI, I signed the VAF contract in April 2007, 2 months BEFORE they changed their contracts for the NCA act

Anyway, advice would be nice... I'm phoning debt counselors as we speak since they are clearly ignoring the arrangement I made with them on the 12th of January
 
they need to prove to you which payments they're missing. If i was you i'd go to the bank & draw statements for said months. The interest that they've lumped onto the car bill for the arrears when you have infact paid will have to be reversed.

They will be able to charge you interest for the recently missed payment(s)...
 
No I'm in arrears. I just got told I was handed over to a debt collector today. This is AFTER arranging with their credit department a payment plan in early January.

that you have a copy of?

unfortunately not, but I did log a complaint with the bank after speaking to a friend who works in HQ and both agreed it's unfair for them to, even after I arranged payment with them and paid R1000 in good faith (what I could afford at that stage), they still handed me over.

FYI, this is for 1 outstanding payment in arrears for 45 days. Not 2 or 3.
 
Go to the ombudsman.... don't even play around tbh....

Banks need to wake the fek up and treat customers with respect.
 
Dear Acid Razor hope fully I can assist as I own a external collections company and deal with issues like yours on a daily basis:

1. Assuming your installment is R2400 per month your arrears should be +- R3800 i.e R1400 arrears + new installment 15/01 R2400
The bank will be more than willing to supply you with a transaction so that you can reconcile your account and payments.

2. Do you have a written acceptance of your arrangement being accepted by the bank. Always cover your ass and email arrangement to bank agent

3. If no written acceptance of arrangement contact credit control manager to discuss your issue. It would help if you remembered the agents name and date and time of call . Dependant on the past conduct of your account, the relavant manager will try and assist you rather than paulling out telephone call records etc.Far easier and less dramatic than involving ombudsman.

4. The bank will not inform you and give you 30 days etc before handing your account to a collections agency. Banks have zero tolerance approach to arrears. A lot of customers refuse to accept this. Fact is the bank lent money to you and they want it pronto.

As explained yours seems like a relatively simple issue to solve provided you have given the "full" version of the story.

Please also use debt review as a last resort. Clearly understand the full implications of what you are getting yourself into.

Thanks, but at this moment the bank is forcing me to retaliate and the only thing I can think of to buy enough time with is debt review. The whole point of phoning the bank to make arrangements on a pre-recorded phone call (and them phoning me instead of written communication) is to solve the issue in a timeosly manner.

Last year Oct/Nov it took me almost 2 months just to get someone from my branch to phone me back. I had to go complain first before they realize "hey, these 30 odd secure messages, I think we should respond to this client nauw"

So email or written notification would have just been one long drawn out process, and since the invoice I had outstanding for money owed to me only got paid last week friday (and not even in full!) I couldn't commit to dates and I *told* them that.

Their complaints decision said it seemed unfair practice to hand me over to a debt collector even after arrangements were made and they'll listen to the tapes. In the meantime, I'm going to blackball STB. I'll cut off my own ****ing dick just to spite them at the moment because they're unwilling to work with their customers to solve a problem and drives us into submission or retaliation for nothing.

I'm on anti-depressants and feel I want to step infront of a ****ing bus just to collect the life insurance so I can pay these mother ****ers. My suicide note will read (to my dad) "Sue standard bank for all you can because THEY caused this, I was well on my way to recovery but they beat me into the only option I thought I had and they need to suffer to wake the **** up and treat their customers as humans"

Been a client with this company for 10 years now. Respect? 0. Loyalty buy's you ****all. If you're R1 overdue, they hand you over (according to the people who followed up for me, I'm only R1430 in arrears for 45 days) but they handed me over...

****ing *******s. I actually have the money to pay them that R1430, but I won't now. Debt review and they can come suck my dick because my monthly income is R0 atm. Selling the car can bring in enough cash to settle my account with them, do they listen? no. they hand me over. *******s
