Paroled rapist can apply for bail

An Mpumalanga man previously convicted for rape has been allowed to apply for bail in a more recent rape case.

The parolee, Lucky Sibiya, 31, of Zibokwane village near the Swaziland and Mozambican borders, pleaded not guilty to a charge of rape when appearing in the Tonga Magistrate's Court on Thursday, a Sapa correspondent reported.

Sibiya was expected to be in prison until 2018 after being convicted of rape several years ago, but was released on parole in 2011.

He was rearrested on January 27 this year after being accused of raping a 25-year-old woman who lives in his village.

The court reviewed his case and gave him a chance to apply for bail. Senior Magistrate Sam Nkuna postponed the application to August 4.

How about we just skip the bail and the trial and chop his tottie off?
 
He is unfortunately innocent, until proven guilty, but the court will look into his past before deciding in granting him bail or not, I suspect he will be denied bail, but the court want to fair by giving him free trial that will start in him applying for a bail.

Give him to the community... they can "interrogate" him.
