Good day peeps,

With this new law there is a bit of a confusion on my side. My son is going to be born soon and I was wondering how this new law allowing fathers 10 days paternity leave. Do I claim those 10 days from UIF? I'm a little confused about it at the moment

My understanding is your company should have a policy for it, and have budgeted for it, so it's like maternity leave? Speak to your HR.

As some companies will have paid maternity, where others dont, I assume you will have to establish that from your company 1st.

If its unpaid I am sure you can claim from UIF for that period of time.

There was a thread about this a few weeks back. As far as I know, the law has been signed by the president but he has not promulgated the effectivity date yet. Thus the new law is not in effect yet.

Start with your HR. But the 10 days will mostly likely have to be claimed from UIF.

You get 10 days, your company policy will decided whether paid, or unpaid, if unpaid, you can claim from UIF.

AFAIK - the new 10-day legislation hasn't been gazetted yet, which means that it's not compulsory for companies to implement. I stand under correction though.

I'm in the same boat and went to talk to our HR today, I was told I've only got 5 for the time being.

The company I worked for said 5 days paid and the other 5 should be claimed from UIF.
Since the new law hasn't been signed yet, does that mean UIF would not pay for the extra days? at least until it's signed.

Company that I work for says it still has to be promulgated (gazetted) before they actually have to abide by it.
Yes, as far as I understand this is correct. I work in the public sector and my HR department says the same thing.

Sucks though, as my little one is due next month... was hoping to get a bit extra leave.

I’m on paternity leave now. Company changed the policy to 10 days unpaid leave.

Called the uFiling call Centre and they said that I can claim UIF later when the law is in effect. Just need proof from my employer.

Whether or not this will actually happen, I can’t say. I’ve budgeted for the unpaid leave. I believe the time off is more important at the moment and will take the financial knock.

Thank you! This makes sense, i thought the law was into affect already, i guess not. I think im just going to have to apply for Annual Leave + Family leave so i only have to use up 7 days of my annual.

Thanks this is not what i wanted to hear but i am glad i got a response from someone who knows :-)
