Polygraph testing only one employee

Wow this has gone t!t$ up :( So sorry to hear that it has gone this far! As many have said, it sounds like your gf is receiving treatment that she is NOT due and getting a lawyer is a brilliant step forward!

You both need to try stay calm, as the more angry and non responsive you get, the worse the situation will get. I really fscking hope you two come right mate! I really do! Assuming ofcourse that your gf is truely innocent (which i dont doubt from what you have said).
 
I'm sorry to hear that, OP. Glad you got a lawyer involved, absolutely say nothing to them until he gets there.

Take them to the cleaners with the CCMA. And the police too.
 
If she wins at the CCMA, what can she get from this company? Surely going back to her employer is out of the question?
 
Would it help the situation if the OP's gf mentions the fact that another employee was in the office on the same morning, but nothing was ever raised with her?

Surely the cops can see that this "stinks" as OP's gf is new in the company and the only one being investigated even when other employees, not to mention builders and contractors were on-site too?

I hope the costs and damages will be enough to sustain her until she gets another job, seeing that jobs don't come by easily for some people. Unless if her industry has plenty of jobs.

Either way, this is a crap situation to be in.

If she "wins"...

As the trust relationship appears irreparably damaged, the employer would probably have to pay her out for the duration of her contract plus any leave pay or bonuses due to her.

That sounds good enough. She can take a 2 months break to recover from this emotional ordeal.

Hopefully her employer does not delay the situation. If her boss is just an employee there, he will probably lose his job seeing that he will have costed the company time and money.

Look... I think TBH you are never better off, usually because once you go to the CCMA the relationship is already gone and its not worth staying (unless you are desperate)
So in the end you get a bit of money to help you find a new job and you get a clean slate.
Your employer can badmouth you and get another fat slap, its easier when they have a judgement against them already.

The only senario where you are better off is when you get moved to a different part of the organization with a new boss, or if your problem was with a particular person and the CCMA decision involves you not having to deal with that person again.

OP: sorry things have gotten out of control. I dunno how much of the advice here that was taken but that's all moot now. As far as CCMA is concerned, I have more bad news. Like it or not, they have rules. One of these is when a person is in their first year of employment, Con-Arb is mandatory. This means that only one hearing will take place. The outcome can go either way. Worse than that, an unwritten law is that the commissioners in a C-A situation will never award more than 6 months.

That being said: go to CCMA, get the 6 months and then use that to sue. And sue big! You may find a lawyer that will take this on consignment pro-bona (I doubt it but it may be an option). May I ask, how old is she?

The pigs (yes pooky, PIGS in this instance!) will take advantage of the naive and try anything to screw them. They tried with me once and when my advocate arrived, all sorts of blame-shifting occurred. While I never got proper justice (the offenders dismissed) I did make them shit themselves when they saw I was a little more informed than they had assumed.
 
This situation is just sad. I also had to go through a lie detector (the voice stress type) before I could start work at a former client. I was fortunate enough to not be a false positive, but I can imagine just how messed up I'd have been had I failed. The worst part is that it took 2 weeks before I got my results back so that was quite nerve wrecking, and I couldn't "bury myself with work" because I couldn't touch the client's system until the results were in, so all I could do was just sit there and think about what happens if I fail.

These things should be made illegal IMHO, I don't know how they were ever allowed to be so popular. What's next, calling in a fortune teller?
 
Attorney tried to get her out today, did all he could. Police officer in charge did not complete papers so there's nothing they can do for her today, honestly I think he did it on purpose. Attorney sat down with her and explained to her what is going on and that he'll be there 7:45 tomorrow morning to get her out. I saw her at visiting hours at 18:30, took her some food, warm clothes. Shes supposed to get her salary tomorrow, don't know if that's going to happen.
Hopefully they will, otherwise I'm also screwed.
She is now charged with prejudice, housebreak and theft.
Shes 23 years old, and got her whole life in front of her.
I hope that everything will turn out OK. I wont be getting much sleep tonight.
We got some legal assistance now so he can help us in our decisions depending on the situation.

I know it's difficult to believe this right now, but everything will work out. Just support each other and believe in each other. I'm sure she will need all your support, especially when it feels like the world is standing against her.

This is all just "formality" and police bullying. Just remember how you feel now and when everything is sorted, you make this company pay and you lay a charge against the police. Do whatever you can but make sure justice is done and that they don't get away with this.

Take it to the press if you have to. Just don't let them get away with this.
 
OP - I am confused - how could they issue a warrant of arrest based on a polygraph without any substantial evidence? I agree with the other posters, your attorney should obviously focus on getting her out and then hopefully start with formal complaints against SAPS via the ICD (http://www.icd.gov.za/) and should also start suing the employer. By the sounds of it SAPS badgered your girlfriend and the polygraph company also showed misconduct - or?

All I can say is this is not normal procedure at all and that once you get her out you guys must sue the pants off anyone involved!

Assuming she is innocent of course, but that must be determined by the investigation, not some stupid machine.
 
I think further down the line you'll find out somewhere the owner of the business is friends with someone high-up in that police station and they pulled in a favour to get her to "confess". BS tactics.. But I doubt the police would do this all on their own.
