Pool Contractor taking long to build..

Well, we can all mention a lot of stuff that you shouldn't have done, buit that would be counterproductive.

You have no recourse unfortunately. It is a bad time of the year, and no other pool company will take over such a project, especially a cement pool.

So you are not going to be enjoying a pool during your summer vacation.

My pool project is starting next year. Right after Easter Weekend.

Doing fiberglass shell and installing it myself.

You better do a thread.

Here I’m fretting diverting my waste line into a tank myself. You putting the pool in yourself.

It is very easy really and pool companies rip people off by charging them ridiculous amounts of money to dig a hole in your garden....

Have you been on HelloPeter? Why isn't there hundreds of thousands of lawsuits filed daily then?

HelloPeter protects the details of the complainant. I have sued a client before for false claims, not only did I win the case but the owner of the website where it was published had to pay also.

If you have a issue with a business or person, rather try working though small claims or lawyer, if you just start publishing **** on the net you open yourself to get sued, especially when there is a fine line to what you can say and what information you may publish.
 
How does that work?

A 2 x 3 pool has the same issues as a 3 x 8....

Bigger pools require a bigger pump if you going solar, more panels, consume more chemicals, need bigger pool covers and cost more to reline in the future. Yes, some of these costs are once off but will cost when the time comes to refurbish or replace.

Contact the Consumer Ombudsman. A contract is one thing whether that contract is legal and reasonable in terms of law is another.
 
Unfortunately the contract does put you in a bit of a bind...

BUT, there were verbal dates committed to... so if their verbal reasoning for the clause is things like weather and the weather hasn't been the delay you arguably could possibly push for them being in breach of contract, but it would be a huge long shot and could very possibly backfire on you and cost you lots of money.

Ultimately, I would start getting VERY otherwise with the company on a daily basis when the weather is decent and there is nobody on site.. Literally a call to the company on the hour every hour of the day... on all phone numbers you have. Just turn into that fscking annoying client so they do the job to get you out of their hair.

That is our current strategy, I call multiple times per day, my wife calls multiple times per day, we send emails and whatsapps. They get responded to but with a long delay and vague answers. They keep constantly pointing to the T&C's. And when they send out a BCC to their client base, one of the things they add is this arrogant "Please keep the constant queries to the office to a minimum, we will get to your site ASAP" kind of BS.

Short of going full mental on them (which is not my style), I really am out of options.

I know they will eventually finish the pool, the issue is the lack of urgency - I had to cancel our holiday as I need to be there to let the workers in and to discuss/agree on the finer details, plus, the holiday period of us being at home is coming to an end and the pool is still not done :(

I think the key lesson here is:

1) Agree on timelines in writing - if they are not willing, then move on to the next contractor who is.
2) Remove any T&C's that you do not agree with - again, move on if they do not budge

I think companies will waste no time in trying to pursue legal aid if the client has tarnished their name - providing they are in the right.

If I was defrauded for example, then for sure I would name-and-shame.

I unfortunately don't have any leverage - I did make contact with FNB Law-on-Call, sent them the agreement and all the communication - the lady helping seems to be pretty clued up.

All I am trying to do is get some leverage to speed things up.
 
I doubt whether these small companies will pursue,too busy attending to 7 other jobs all at the same time lol

do u do this professionally.... looking to reduce my pool size...any ref or suggestions?
 
Just to report back, my pool was finished last week, almost 4 F'ing months, just in time for Autumn :mad: At least he didn't run away with my money, which would have been worse.

I'm glad it's done though, the contractor asked if I can send photos of it finished with all the last touches for his Facebook page, needless to say, I simply ignored his request - doesn't feel like justice but just a little tiny F U from me.

Moral of the story: Ensure that timelines are very clear in the contract.

Of course you send him him photos, on the top of the photo the start date, bottom the end data ... and in the middle the number of days it took. also post it on your own facebook page :laugh:
