Poor workmanship - what are my options

Hi All

I was a victim of poor workmanship late last year when a painter did a very poor job. The main issue is that he talked a good talk and hence was paid in full prior to checking. I was away at the time and my wife did this, so before we all say how stupid that was, we now need to rectify the issue.

below is the issues
1) I was quoted for work which was clearly not done, no primer put on windows before paint.
2) General poor quality of work
3) Did not even move a mirror and just painted around it


Once I saw the issues I got the chap back and he fixed all the area's where I have moaned at but claimed his work was good. Now I could see the metal under the windows so I knew he had not primed it. In order to strengthen any possible claim against him when requesting he fix the problems I drew his attention to the fact that he gave a 5 year guarantee on workmanship.

Now its 8 months later and 2 of the 4 rooms painted have started to peel. I have forwarded the last email I sent to him and given him time to respond ( and a follow up email ) but guess what he is not responding.

His work was so poor that I actually want to teach this guy a lesson, he needs to learn the hard way and stop doing this or close shop. I dont want any other people caught. Should I go the small claims court route or contact a lawyer?

How easy is it to proceed. All i want him to do is fix his issue but truth be told I dont want him back ( as I think his guys stole a iphone 4 from us - however with no proof I cant do anything )? I have a work contractor who will give me a quote to fix the problem, I was thinking of trying to sue him for damages/costs to repair. Is this an option ?

I have emails complaining, photos of damage.

You employed a chancer and failed to supervise.

Heck, even good painters need constant supervision. I used to watch our neighbour's commercial painter smoking while he talked and painted. I wouldn't pay him 5c for all the time he took painting the same spot for 3 or 4 minutes. They then employed another person to remove paint from where he coated the windows.

It's likely the guy is poor and you won't get money off him. Rather deal with the remedial work and don't provide references. There is no good outcome to this story.
 
I am interested in trying small claims court as it could be fun, also I look forward to making his life more frustrating if possible. Will see and will keep everyone posted on what happens. Could end up being fun.

Just keep in mind you'll have to document EVERYTHING in order to present it as evidence.
 
Thanks, luckily I have. Have the emails, the non-response emails, the emails on requesting him fix it, the pictures of the peel and now just waiting for our new contractor to give me a cost to fix.
