Post accident advice

Hi guys

So I was in my first accident yesterday with a pensioner.
I filed a police report, got all the relevant details.
Damage to my car is passenger side fender, passenger door, passenger side suspension is busted, probably the shocks and burst passenger rear tyre.
Car still drives but passenger suspension needs to be fixed ASAP.

Since its third party, when do I let my insurance know of anything?
I phoned them from the accident scene and they didnt get back to me, since I only have third party and my car still drives

Basically I have 3rd party insurance and the the other motorist has none.
How do I go about getting the damage to my vehicle sorted out.

Also, since I have third party and they claim for damages, will they get covered by my insurance, and I am at the mercy of their finances?

Could I not strike a deal as follows, as I have a feeling they wont have the funds too cover the repair to my vehicle:
- Ask them to claim my insurance and whatever funds they would have used to fix their car, they will forward it to me?

Is this legal what I propose to do?

I have Toyota Tazz, so the repair cost wont be that much. I however am not in a position to fork out this unexpected amount of cash to fix my car

Please advise

Yes, illegal. You're screwed.
Damage to their car will be covered by your insurance.

Who was at fault?
And yes, your insurance will cover them only not you,
Its definetly illegal to get money back from them, unless you got some proof it was there fault, did you get photos/videos at the scene?

Could go the small claim route, but I doubt if you'll get enough for repairs to your car,

Forgive me if im wrong; car sounds totalled, chassis bent, can't be easily fixed, not unless its a hiace:D and you don't really mind!

You dont say who was at fault as that will make a big difference. What did you write in the police report?

When it comes to divorce and MVA's there is no room for love, pity or forgiveness.

1) Report to your insurer officially and get a claim number so there is no right of recourse against you.
2) Get 3 quotes from panel beaters you trust and submit to the TP saying you hold the responsible for the damages.
3) Await their reply/response giving them 7 days in which to advise on how they going to indemnify you and or repair your vehicle and take it from there.

Sounds hard and tough but such is life.

I'm a nice guy and I don't want to put burden on other peoples financials.

The other driver was at fault.
She was turning right over a solid line, even thought there was a right turn lane which she just passed.
I saw her indicating right at the last moment (old corolla dim as dim can be for a turn signal) and realized I was going to rear end her, tried swerving around her to avoid an accident and she ended up turning into my car.
Both our cars ended up in the only go straight lane, so it can be clearly seen she was turning illegally. I got the pics to prove it

In that case she cant claim anything from your insurance and if you try to you will be commiting fraud.
She should have had insurance even if it was just 3rd party like you or not driven her car.

Right now you are in a tough spot you can choose to go the small claims court route(max of R15000) and see if she has the money to pay or just leave it fix your car and get on with your life.

Tough one, don't be depressed, these things happen, could have been a LOT worse, no injuries so all that damage is metal, and that's easy but expensive to fix.....

Id start with reporting to insurance,
Then get quotes, but not be suprised if it cost more than the car is worth....

Id say you need to get cash from the other guy first, or something needs to be worked out between the 2 of you, like a loan or payment plan.
Can't spend cash on trying to fix there car, as your insurance will spike after this.....

Out of interest, did they have a valid licence?
Could be they disqualified from driving?

OP, please get more comprehensive insurance in future.
