potential Unfair dismissal. solution needed pls.

I have a friend who is studying medicine, and was suppose to be doing her 5th year this, but her university is giving her problems with registering. She started studying in 2007 and was studying BSC(for 2 years). 2009 she got admitted into medicine. Now this year they are telling her that she has exceeded the number of years she had to complete her course. They say the 2 years she studied BSC is included with the number of years she studied medicine,which doesn't make any sense to me. As far as i know if you start a new course you start from scratch previous course dont have any barring on the new course. They didn't fail any subjects last year. This year(2014) she was suppose to complete her course, but shes only gonna be able to do that next year(2015). She did all this in the same university. Is it legal for them to do this. She never got any warning letters. Is the any place to go to for help about such matters independent from the school.
 
It doesnt sound legal, as you say, she changed degrees.

Ask her to point out to her which part of the university's rules they are using to exclude her for the year. In other words, get them to lay out their reasoning and substantiation.

Your last half doesn't make sense... Has she failed any subjects or not? Which university is she studying at and what's the duration of her course?
 
As stated above, which University? This should be covered in the university booklet you get when registering and i would guess online aswell.
 
Was she signed up for a full load of courses last year? If she undersubscribed and now has to take an additional year to finish, then the university has a case. If she failed in the past, but attempted and passed a full set of courses last year, then the university was probably supposed to kick her out when she failed but overlooked it, and only picked it up now. In this instance, she would be re-admitted if she were to appeal to the dean of her faculty.
 
The school is university of Pretoria. The regulations say, these are from 2009 when she enrolled for medicine - time given to complete a course is the duration of the course plus 2 years.

Regulations were amended 2012 -
Should a regulation,according to which a curriculum has been compiled, be amended, a student who has started his or her curriculum under the old regulation and who has not interrupted his or her study, may complete such a curriculum in accordance with the old regulation on condition that a faculty board may formulate special transitional requirements in order to enable that
student to complete his study in accordance with the new regulation.

A student who has been registered for a degree programme and
(a) who has failed to renew his or her registration for such a degree programme in the ensuing calendar year; or
(b) who has failed a year of study; or
(c) who has not complied with the prescribed requirements for progress in accordance with faculty regulations
is deemed to have interrupted his or her study and forfeits the right to continue studies under the old regulation.

Could some1 please explain to me what it means to fail a year of study, a bit confused about that 1.

Yeah thats what i was thinking, that she was suppose to be kicked out when she failed. She is in the process of appealing.

The rulebook should specify that a certain number of credits at a certain level is required to progress from one year to the next.

She has more than enough of those, that's why this is so puzzling. Their reasoning is the number of years she has studied. She has only studied medicine for 5 years but for some reason their adding the 2 years she studied BSC into the equation. From the 2009 regulation she was suppose to get 8 years. Is the a place she can go to complain about this outside the university?
