My understanding is that, yes, it can be done. My commercial law is very hazy (did first year of it over a decade ago and no further), but from what I can recall, deliberate misrepresentation to obtain an employment contract will render said individual in breach of said contract, and the company would have legal discourse to terminate the contract.

If any legal expert around these parts can prove this either right or wrong, that would be great. And no, a union shop steward is no more a legal expert than a porn star is a virgin.
