PS3 game return to Game Stores

Just a question for all those knowledgeable with the CPA.

Just bought a PS3 game for my nephew for Christmas today. Now found out he has that one already...stupid, I know...he wanted the 3rd version of the game.

Can I take it back to them for a refund?

Thing is they don't keep the disc in the box so I got it unwrapped etc. They are closed now so I can only go in the morning.

They will probably let you exchange but doubt you will get a refund.
