So, I go into this store and buy 20 size D widgets. I get home and find out my situation requires size A gadgets. I return to the store and they say "No refunds on cash purchases" so sorry, tough titty.

How does CPA protect / affect me? Do I have rights?

Of course you do. Enforcing those rights is another issue altogether.

You have the right to return the items within 10 business days for a full refund, no questions asked. The goods clearly do not fit the purpose required and this is explicitly covered in the CPA. While it is intended to protect consumers from questionable advice provided regarding the correct products to use, it still covers consumers in the event that, without suggestion from the retailer, the consumer makes a choice and identifies that the goods are not fit for purpose.

This is my understanding at least...

Thanks. I walked into a store 2 weeks back, bought some things and they were unsuitable. Upon returning them, their sign read "No refunds or returns on cash sales" which I felt was in direct contravention of the act. I had to argue with these okes for 30 minutes before they realised how serious I was. Suffice to say, I got the exchange but I still feel like taking action against their illegal store policy.

What's the point if you've already won?

Well, that is a valid observation - it will hold no benefit for me. BUT....

When it comes to fixing things that are wrong, should we have this approach of "It doesn't affect me so why bother?" or should we try get something right? I'm in two minds about this personally. On the one hand, I feel we should do our best to correct whatever we can but another side of me says why bother. Why bother when the powers that be whose duty it is to take action (Icasa is a great example) are toothless. It is like farting against thunder and eventually, I just get tired of fighting the wars that are not mine to win.

Hi Guys

I recently bought items from a second hand store however I never noticed the no return no refund sign. This guys is selling stuff but refuse to take them back or to refund if not working.
How do I go about to report these people but I feel they making big bucks for selling stuff that's not working.

Thanks in advance.
