Quick Question Regarding Leaving a Company

Is there a law regarding paying out an employee his final monies owed to him by the company he worked for? Is there any reason, apart from debt situations like study loans etc that they can refuse to pay me out my final salary?

The company I work for (in my last days of notice month before leaving) has their employees do regular medical check-ups at an in-house company clinic. You also have to an exit medical when you leave so that they cover themselves. Due to prolonged industrial action by the unions, the company has been pretty much closed down for the last 3+ weeks. All non-striking employees have been told to stay away from work due to safety concerns until further notice.

Next week is my last day and I will now miss my scheduled exit medical. Is this a valid reason for them not to pay me my final salary will includes a tidy leave payout and 13th check? Can I be forced into a "no exit medical no payout" situation?

I have no real reason to be difficult but I am starting a new full time position right after my last day of notice. I will probably not get time off and if I do it'l probably be unpaid as I'll have no leave built up yet not to mention looking like a tit when asking for time off almost immediately after starting.

Advice?

Any salaries paid out would be in respect of work already done. Not going to a medical does not mean you have not done your job. Ordinarily, not going to a medical, depending on the terms of your contract, might get you disciplinary action or a written warning, but would unlikely to be grounds for either dismissal or witholding salary.

In fact I cant think of a single reason why a company would be entitled to withhold a salary from someone.

I am not a lawyer though. Have they threatened to do this, or is this just something you are concerned about?

If you are just concerned about it, just phone your boss and ask him.
 
Ask your current boss if he can't arrange for the exit medical, even if it off-site. If all else fails explain your situation to your new boss immediately you arrive: that way it's not a surprise to your new employers if you are still required to have the medical.

I can't see that your current employers can withhold a portion of your salary for a situation that is beyond your control.
 
No, they cannot withhold monies owed to you, and they must be paid by the 7th of the month (assuming your working period was the 1st day to the last day of the month)
