R500 billion disaster

Coupled with the fact that there are so many unskilled drivers on the roads causing so many (preventable) accidents, it's no wonder.
 
The only thing that astounds me really is how the hell this poor country manages to wake up every morning and keep stumbling along. I struggle to bring to mind any aspect that is not a disaster, insolvent, broken, dysfunctional or corrupt to the core. I truly cannot think of one.
 

Accident fund battered by foreign claims - LegalBrief Africa​

Fearing that it is being bled dry, the Road Accident Fund (RAF) is engaged in a fight against claims – especially those from foreigners – which seem not only excessive, but also suspicious, reports City Press.

RAF CEO Collins Letsoalo revealed that one such claim had come from an American woman who wants $8.1m for psychological trauma she suffered when her husband died in a road crash in SA. Letsoalo confirmed that the agency was disputing this with everything in its power.

Equally remarkable, he says, was a claim from three Belgians who were exchange students at the University of the Witwatersrand when a bus they were travelling in was involved in a crash and they sustained injuries. They are now each claiming $8.5m from the fund.

Letsoalo said the Belgians’ claim was still at the processing stage and that the RAF would have to fly the three claimants into SA. It would also have to send officials to Belgium to validate information, which he said was a cumbersome and costly exercise.

The highest payout made by the RAF had been to Swiss billionaire Joachim Werner Schloss, who was paid $27.6m in 2008. Schloss lost an arm and a leg when a motorist, driving on the wrong side of the road, crashed into his hired motorbike between Cape Town and Stellenbosch in 2002. He had originally claimed $243m.

Said Letsoalo : ‘I’m sure those who drafted the Road Accident Fund Act didn’t foresee that the scheme would, to a larger extent, benefit foreigners. I don’t know of any injured South African who’s ever been paid more than R15m.’


According to City Press Letsoalo said he was concerned because the RAF Act stated that all persons who had entered the borders of SA could claim from the fund, but did not specify the status of their presence in the country.

He said section 44 of the Immigration Act placed an obligation on state organs to ascertain the status or citizenship of the persons receiving its services and to report to Home Affairs individuals whose status could not be ascertained.

He said this loophole meant that even illegal foreigners could claim from the RAF. The fund, he pointed out, had been criticised in the past for demanding proof of the immigration status of claimants, although this had prevented illegal immigrants from receiving payouts.

 
Easy fix, make it law, all vehicles need prove of insurance to be able to be on SA roads.

If you want to p1ss your money away monthly on insurance companies that have us by the balls because of government mandates, be my guest.
I'm a big boy, I can manage my own financial risk and associated collateral and have saved ungodly amounts doing that.
I don't need some tie-wearing desk d**s with a computer black-box telling me what my risk profile is.

Funny cause when you or people like you moer into me for whatever reason you're always the first ones to blame and sue the pants off anyone. Ja nee mnr for the masses unfortunately we need insurance haha

I have lost two vehicles due to people driving into me.
This is why I now drive a well-maintained shitbox that can be replaced with about 5 of 6 different ways of funding the replacement in cash.

If, for the first time in 25+ years of driving I happen to drive into someone they will get every cent I owe them in cash.

If this country had proper public transport I would have agreed with you, but driving here is a necessity and not a luxury like in some other places, so no, forcing people like me to have insanely overpriced vehicle insurance would do nothing. I'd still keep doing what I do now and so would the ones currently driving without insurance. It'll just open up yet another vector for corruption and corporate fleecing.

Right, you've got millions saved up. Write off the wrong car or damage someone's property and hope you've got enough saved.
At least get 3rd party numpty, if you want to be careless over your own car sure, but at least cover a 3rd party that can make you end up in debt for the rest of your life.
Cars are not cheap
 
Compulsory 3rd party cover should be law. (Then again everyone breaks the law in this country). No cover and you are in accident fine should be 200% of the damage caused to the third party or jail time.

Then again I hate insurance companies. Many years ago someone reversed into my car in a parking lot trying to get out of his parking spot (Basically he reversed while I was behind him standing still because a car was standing in front of me so I couldn't move).

Tried claiming through my own insurance, but the difference between own risk and amount to pay was about 2k. Was told by the agent probably not worth to claim as my premiums would go up as they wouldn't pursue the matter with the other insurance company.

Took the battle on with the third parties insurance and not claim from my own. They just hoped I would give up, which I did not, but it took 2 years before they paid me out.

I hope for the R8000.00 it was Santam (the 3rd parties insurance) worth their time to try their luck.

But I probably would have wasted my time with a third party who did not have insurance and money.

But I figured out for small claims your own insurance is going to do fock all to claim back from another insurance and you just pay your no claim part and get an increase in your premiums.

But then again Santam which I had my content insurance for over 20 years got back at me when I moved to a different property and they did not want to insure me for home content anymore as I moved to a high risk area according to them. Actually i moved to a safer area with less risks. (Access Control and Right next to the security as well).

I am paying less for the same cover with a different insurer now which is underwritten by Santam
