So a month ago my daughter drove in town, a person drove turn out of a parking and his car hit hers. She took all his info and he said he does have insurance and he is good and honest and bla bla.

She found that her broker gave her a car insurance, 3rd party only. So she phone the other person, suddenly he does not have insurance, and he start to ignore her.

So today she went to the police to open a case. The police gave her a R500 fine for late reporting. Now she and I is upset. Imagine , you go to report something and they fine you.

Where at the courts can she ask for discount on the fine.

Does the rulebook not state that an accident should be reported within 24 hrs of the event?

Im sorry but is your daughter some sort of sheltered kid who lived under a rock? (im being nice here the word idiot comes to mind )
she didn't report the accident on the day, she has insurance but only finds out now its 3rd party, and is only claiming repairs a month later - and you worried about the fine the cop gave - ya priorities.
the fine well it legal (sort of) area take it to a magistrate they may reduce or scrap it bit honestly you failed as a parent!
my dad would beat my ass if i didn't report the accident the same say (he would still do it today)

hmmm...makes sense on paper but I can see why OP is upset.

No good deed goes unpunished...

No no, tell us how you really feel!

Just name and shame him! Put his number plate on here and all information you got.

To the best of my knowledge, only if someone suffered serious personal injury or death in the accident.

If there is damage done it must be reported. If there is only property damage (which you'll never know since they "may" have whiplash) then the next business day is fine, if injuries of any kind you have to go within 24 hours

1) The driver of a vehicle at the time when such vehicle is involved in or contributes to any accident in which any person is killed or injured or suffers damage in respect of any property, including a vehicle, or animal shall –
f) if he or she has not already reported the accident to a police or traffic officer at the scene of the accident, and unless he or she is incapable of doing so by reason of injuries sustained by him or her in the accident, as soon as is reasonably practicable, and in the case where a person is killed or injured within 24 hours after the occurrence of such accident, or in any other case on the first working day after the occurrence of such accident, report the accident to any police officer at a police station or at any office set aside by a competent authority for use by a traffic officer, and there produce his or her driving licence and furnish his or her identity number and such information as is referred to in paragraph (e); and

Ask the broker for a recording that the top cover was agreed on and accepted by her. According to the FSP FAIS act they have to record all communication. If she wasn't aware of the cover implications and no record of advice is available then they should be held accountable.
I thought only if there were injuries one had to report within 24 hours.
It's probably too late to claim even if there was comprehensive cover.
I suggest the broker advises and assists with recovery or uses contacts at the insurer to recover.

Need to report within 24 hours if someone is hurt or killed, if not next working day - That is why they have levied the fine.

Correct, but given that the cop shops generally have charge offices that are manned 24 hours these days, i've always reported my accident pretty much right after its happened. it is just one less thing to worry about...

How many times did you had to report such a thing to the cops.

In 36 years, I had 2.
My wife = 36 years = 0
My daughter = 4 years = {1}

Have some dignity and suck up the fine. Everyone in SA (except you two) knows that the first thing you do after an accident is report it at a police station.

you can't be the only 3 people in your world who had to report accidents?
Friends, family, work colleagues and acquaintances ?
Do people not talk to each other in the month since the accident did no one tell you or your daughter to report the accident?
As for the broker did your daughter request comprehensive insurance, what exactly happened that she ended up with 3rd party?

Ok at least i know i'm not the only person that found this absurd
