REPORTING ISP FOR THEFT

Hi Guys

Just wanted to know where i stand w.r.t. making a case against an isp for theft. Let me start off with my story.
I used TRL Technologies earlier in the year as my isp and they also took over my line. I cancelled with them and asked them to move my line to Telkom. I battled with them to get my lline moved and they also deducted money from my account when i already gave notice 2 months prior. i eventually got my money back after numerous persistent calls and being told it was told errornously on their system.

yesterday i noticed on my internet banking that they deducted again money from my account after i left them already a few months already. this is blatant theft. can i lay a charge of these people at the police and can i get the bank to refund me the money back and also tell to block any transfers from my account.

What do you mean you battled? I thought the process was painless and efficient?
 
From the details you provided, it doesn't sound like theft. It sounds like an error. Or at most a civil matter. The police don't want their time wasted with civil matters. Are you actually serious?

I can see how he is serious IF it comes to light that the company bills people who have cancelled their accounts with them previously.

If you bill 100 people R100 and those 100 people have no service with you, you stand to make some big bucks if nobody complains huh?

First he needs to get more people who this is happening to on his side before making a police statement

OP says they already previously refunded him some overcharged amount. Just find that unusual behaviour for thieves.
 
It amazes me how often this happens with ISPs. A story like this crops up quite regularly here.

How hard is it to maintain a database that actually works? Are they using an Excel file or what? "Ish, i deleted system32, think i must use recovery disk created 2 months ago" :)

I wouldn't take it as far as court (long time for anything to come to fruition, legal fees probably end up costing more, etc). Just contact their accounts department and sort it out.

yea, refund the few who catch on after a lot of hassle and smile all the way to the bank with the rest.

There is no excuse for debiting an account after the account has been cancelled. Piss poor form on the part of TRL Tech.
 
I still believe time would be better spent speaking to their accounts dept / his bank / ispa / dti. But good luck with the SAPS :)

How is this not theft when they just take money from my account without consulting me. that my friend is theft. how would you like if you cancel an account with a company and 6 months down the line you pickup that the company just felt like taking money from you when you have cancelled and send the paperwork through. its BS that companies get away with this and just say, sorry we billed you incorrectly. how that fak can it be that they billed you incorrectly when the account was closed and agreed by both parties. this is where the CPA needs get involved and fine these people for robbing people. its not a mistake, they do it on purpose to see who will make the effort in contacting them and try to get their money back. why do we Saffers take this crap and nothing gets done to this comapanies. we need to put something in place that will eradicate this kind of things taking place. for every issue they will be fined an x amount of money.

I am currently with Webafrica. i had no issues with them whatsoever, no billing issues, etc. why can't other companies no matter how big or small have the same business ethics.

bunch of crooks. my emails are returned and dialed 3 numbers. cell off, landline keeps ringing and call centre keeps ringing.

at least got the bank to cancel the debit order. warning to anyone dealing with these people.
 
When a debit order is stopped by a bank, the beneficiary gets charged. They should then realise their error and cancel the instruction.

However, be careful that your notice to stop payment only lasts 3 months. If I were you, I would renew this stop payment instruction before the 4th month's usual debit date. I had a run-in with Neotel who, ignoring the fact that a contract had lapsed, continued to debit my account. I put a stop payment on it, but 4 months down the line, the debit order started again. Only an eventual comment on Hello Peter stopped the debit order, but I am still awaiting the refund of R 4240.
 
This is one of the very few reasons i only have 4 debit orders on my account..

My bond, my car, my insurance and my medical aid..

Everything else gets paid by me.

Its the unauthorized removal of a person's funds. What would happen if you left an envelope full of money on the table, I "accidentally" took it home, and then spent 4 months promising to refund it? You would call the cops to get your money back.

I kinda think, maybe if more people did call the cops when this happened, it wouldnt happen so often. Right now, at worst they apologize and eventually refund you, when it suits them. Sorry if your bond repayment bounced and the bank took your house - too bad! We'll give you your money back when it is convenient for us in terms of cashflow. Maybe things like this need to go to court so that, if a debit order is taken in error, it needs to be refunded like the same day.

Or otherwise the banks need the power to do something about it - to take the money back if the holder of the account disputes it. I can do this with my credit card, why not with my bank account?

I spoke to the bank consultant explaining my grief that my hands are tied from stopping these people in stealing my money in broad daylight and all they can say is that i pay R30-R4- each time i ask them to stop the debit order. why the fak do i then use the bank to protect my money and i pay the motherfakkers every month. all they need to do is delete or stop them from taking money form me. i think is should go to Capitec bank. they are just like the law, protecting the criminal where as i have to run around fighting for my rights. maybe i should go on hellopeter and tell Standard Bank to go fak themselves. Only in SA where you get ripped off like this.pathetic

Make no mistake they do have the power, but as they're charging transaction fees both ways it's just not in their interest.

so why do i have to beg for my own money. they should allow the account holder to stop it immediately and then let the debiter enquire and give reasons why it should not be stopped.
