Hi Peoples

I have a friend who is a British Subject and has overstayed her welcome in SA. She is married to a South African. Our very efficient Home Affairs Dept. is at a total loss as what to do with her, one crowd wants to arrest her:confused:, another says to leave the country and apply for her permits from U.K.:confused: She is not a fence jumper.:D She has a geology and Msc degree. WTF do we do to solve this.
 
I've got a friend from the UK who wants to move here. His Visa has also expired. He's also married to a South African? I'd also like to know?
 
Nobody seems to have a solution, any Zims, Nigerians, Ethiopians, Malawians, Mozambicans on this forum.
 
Don't they automaticall become SA citizens when they get married . . . like in the movies? Or is that only in the US?

It's not even like that in the US.

To the o/p when I had problems hiring a lawyer seemed to help.
 
As far as I know, you can become resident once you've married a South African citizen, but you still need to apply for residency. Doesn't solve the Visa issue though..
 
Appart from applying for a job, I have never had anyone ask me for proof of being an SA citizen. So the staying part is not the problem, the working part is :)

You can. It just takes a few years before you can apply now.

Once you are married to a SAFA, you should get a spousal work permit asap. I did and it only took 3 weeks. You can do it from within SA, no need to go back home.

Before they try to arrest you, you need to show them the marriage certificate, it is then unconstitutional for HA to deport you.

May I suggest you contact a lawyer to do this on your behalf, removes all the hassles.
