The commission I think is actually against the law

No I don't think it is against the law. We have 14th checks that only gets paid out 6 or 7 months after the financial year end because it depends on the success of that financial year. But if you leave before it is paid out, you also don't get that pay. People tried to fight against it but I think they lost.

I'd rather say 'see? This link says you must pay me ...' and nudge them

You dont have to start the mediation, just call them and ask them what the law is and what sections of the act are relevant.

Fight it how, because it is almost certainly illegal.

Yup - on the payslip.
Then they have no leg to stand on regardless of whether it is legal or illegal to strip an employee of leave above a certain level.
