Well it depends, in the US with no contract does the copyright belong to the subject or the photographer? Would only be illegal if he charged to take down pics to the copyright holder.

The photographer. It's always with the artist/creator and not the subject. Of course, as you said, contracts modify this.

Well there you go, only illegal if he charged for taking down selfies. Photo's taken by the other party belong to them and they can do what they like with them.

In this case you could try a defamation or similar case, but not one based on copyright, no.
 
Truth is ultimate defense against defamation, unless the photo has been edited defamation won't work either.

Defamation is the wrong word. You do have some rights to privacy, and you can under certain conditions expect privacy, though this depends on who you are. Public persons (like celebrities) have fewer rights in this area. If someone posts a nude photo of you without your permission, then you could expect to make a civil case against this person. Whether this will succeed or not depends on various laws (like the ones above), and how the jury at the time feels. And if the judge feel the case can proceed or not.

I believe it would be possible to find a way to sue, perhaps for emotional distress, perhaps for loss of income, perhaps for defamation. Perhaps some other law.
