Road closure in my area

Hi All,

I hope someone can shine some light in this topic for me, i have been googling but cannot find the results required. Recently they closed down my area (boom gate), it is a free standing house and I was against the entire process for a number of reasons, but mostly as none of the committee involved could tell me what the costs involved was. Now i'm contemplating whether to sell my place or not, estate agents tell me that the committee can block the sale of my property until the outstanding fees are paid?

ya what he said - you not in a HOA so there are no outstanding levies etc - as long as you municipal fees are up to date.
on the enclosure are you sure it legal ?
also where are you joburg, cape town etc? as there are municipal laws that protect you depending on where we can get you specifics for your area

Johannesburg, according to the people running the committee it's legal, but i've never seen a road closure happen this fast.

They definitely cannot force residents to contribute. It is entirely voluntary.

100% as the previous responses, if not in an HOA, they got no grounds.

Many of these road-closures are illegal, most either fail or do not go through the proper traffic dept. inspections e.g. application, traffic-count etc.

I don't have a problem with the closures in general, as long as its part of an HOA or all the residents are on-board. In most cases, the traffic impact might be very small, so no-one will ever complain. But if they get arrogant about it, flip them the bird.

Tell the committee to go and coitus itself very unpleasantly....

You do not have to contribute, and they cannot block the sale of your property.

In fact if they try threaten to disrupt the sale of your property try get that in writing. Would enable you to tear them apart in court as they have then committed blackmail.

just are you moving because of this or just for other reasons and this is giving you an extra headache.

Ps I went digging for some more information and according to the information I received the road closure was signed up under a HOA. Does my rights on my freehold property differ in the case? As I did not sign any agreement to join the HOA

If you signed nothing to join the HOA, then your property is not part of the HOA...

It would be interesting to see how they managed to organise an HOA and what common property is registered to the HOA etc etc etc...

Also interested to see the HOA agreement, I've been reading up on a number of these things and apparently most of them don't hold under scrutiny...Regardless i wonder if these buggers realized some of the possible implications of HOA agreements, like for example any changes you want to make on your property needs to be ok'ed with the HOA. Exactly the reason why I did not want to purchase a sectional title
