Road eccident fund pay outs

Hi im asking on behalf of a family member,how long does it take for Road eccident fund to pay out ofter a settlement.

How long does it take the Fund to process my claims?

The Road Accident Fund must be offered a reasonable period of time in which to assess its liability in respect of the claims lodged, enter the claims into the relevant computer system, perform the necessary enquiries, and thereafter arrange for Electronic Funds Transfer directly into your, or other nominated bank account.

You will be advised by way of a letter which claims have been admitted, how the amount of money paid into the bank account was made up, which claims require further explanation and which claims have been rejected as not being accident related or a claim in terms of the Undertaking.

A fscking long time! I know someone who was knocked over and had to have hip replacement surgery in 2009. He still hasn't been paid out, and judging by the way things are currently going, I doubt it's going to be any time soon.
 
Thanks for your replies....and yes we asked the lawyer he said a month to 6months
 
Know someone that works as a lawyer dealing with this - they average about 4 years from submission to payment.
 
Surely it should be illegal to take that long... What if someone needs operations to save their lives, which can cost millions?

I think this is for personal injury claims not RAF approved hospitals which were (as recently as December 2016) being paid according to the hospital my dad was taken to.

Sorry, what is a RAF approved hospital? And is any injury you suffer on the road due to accidents, not "personal injury"?

Where are people keep getting this notion from?

I hear it year after year...yet I know of people being paid out regularly.

It's to recuperate costs more than it is to foot the bill on your behalf.

Also usually goes hand in hand with a deeper investigation and often is reliant on the attached cases to be resolved such as is the case with an accident I was involved in where the driver was being charged for drunk and/or negligent driving.

Just look how long the very high profile Oscar case took (and is still taking) now put a "normal" person in that position.

Only certain hospitals deal with Road Accident Fund related accidents. If you are involved in an accident in JHB east rand - chances you will be taken to Sunshine Hospital in Benoni. They accept RAF cases. My dad was involved in an accident in Dec. Broke his leg as a passenger of the car. Ambulance took him there (25 minutes away) vs Arwyp Hospital (5 minutes away) because the later didn't handle RAF cases. Doctor explained that he can also choose to engage with RAF for a personal injury claim for loss of earnings / pain blah blah blah... But also said that because lawyers were milking the system and other irregularities - it was bankrupt and chances of a payout in the near future were slim to none. Doctor mentioned that hospitals were (at that stage) being paid for services rendered to road accident victims. If thats changed since December though. I am not sure.

Assuming you have no medical aid that is.

If you have Medical Aid then they will cover it all but will make their own claim against RAF or expect you to pay them back in full if your personal claim gets settled.
