A Russian court has released from custody opposition leader Alexei Navalny less than 24 hours after convicting him of embezzlement and sentencing him to five years in prison.

The release came after a surprise request by prosecutors, who said that because Navalny is a candidate in this fall's Moscow mayoral race keeping him in custody would deny him his right to seek election.

The release is to extend until appeals of his conviction are completed.

After the Friday decision, a smiling Navalny emerged from the caged-off defendants' section of the courtroom and thanked supporters who held protest rallies on Thursday after his conviction.

Well when you appeal you generally get released until your appeal trial and ensuring the judge you are not a flight risk. No passport.

At least now people can see the government has not forced him to stay in jail, putin does that i have been told to the opposition.

Russian opposition leader Alexei Navalny has returned to Moscow after his surprise release from jail and says he will push forward in his campaign to become mayor of the Russian capital.

Navalny was sentenced to five years in prison on an embezzlement conviction on Thursday in the city of Kirov, but prosecutors unexpectedly asked for his release the next morning. They said that keeping him behind bars during the appeals process of his conviction would deprive him of his right to run for office.

A day before the conviction, Navalny was registered as a candidate for the Sept. 8 mayoral election.

Hundreds of police blocked Navalny supporters from the platform of the Moscow railway station where his overnight train from Kirov arrived on Saturday morning.

Escape what, he was put in prison and then processed properly, why would he need to run? If putin wanted him in jail he would have stayed there. Flight risk, yet he is a free man. Why does he need to run? He is running though, for mayor :D
 
I get the impression that there is far more to this story that will never see the light of day...
 
Hardly. This certainly wasn't done out of the kindness of his heart...

Considering what people think of him, surely he could have ensured he stayed jail? Like the egypian army, take over and lock away the president.

Anyways there may be more to the story as you mentioned.

Nope free to take part in elections. Killing him now would be a bit obvious, killing him while he was on his way or in prison would have been less obvious. Escape attempt or anything really, cell mate knifed him.

As far as i know and DJ or whoever are welcome to correct me but you can appeal a guilty verdict and then you have two options, wait in prison or released until the new trial. You think putin can kill so easily so was it so difficult to keep him locked up on the basis of being a flight risk? Not entirely sure if that is how the options work in russia but if you are considered a flight risk you will spend the time waiting for your new trial in prison which will then be allocated to your sentence if you are found guilty. As i said this is my opinion no idea if that is how it works but flight risk vs killing someone. Seems easier to bribe the judge or threaten the judge.

If the accused was originally granted bail, that bail is often extended for the duration of the appeal process. If the accused was denied bail & in custody for the duration of the trial, they are usually remanded into custody for the duration of the appeal process.
The appeal is usually against the verdict. If that fails, one can appeal against the sentence. (think Sheryl Cwele here)

Let's say he was granted bail prior to the case being heard, then he is convicted. In theory he will more than likely be convicted again or there is a big possibility so if putin wanted to keep him in jail he could surely get the judge to say he is now a flight risk and get the judge to detain him until the new trial?

Not sure if that could happen but seriously believes killing him is easier than keeping him in jail and out of the running. Sounds odd to go to such extremes when jail would work just as well, assuming the judge has the power to deny him bail until the new trial.

I would imagine there is less chance of "outside influence" when it comes to an appeal. Appeals are generally held in higher courts.

It seems a little odd that someone convicted of a criminal offence is suddenly released in order to allow them to stand in election for public office.
I suspect there is something much larger at play.

It just seems a little odd that someone having just being convicted for embezzlement is suddenly released to stand election for public office.
(remember now, he has already been found guilty, his appeal is yet to be heard).

Look at it locally.
Let's say Tony Yengeni or Schabir Shaik have just been convicted of embezzlement (assume this to be their crime for the purpose of discussion), and a couple of days after their conviction they are released from custody for the express purpose of running in an election for the position of mayor - does that not seem a little "unconventional" ?

Perhaps there was someone pulling strings to entrap him, or have reason to get him out of the way. Maybe their grand plan is unravelling at the seams & they are thinking (or even negotiating with him ) to let him run for mayor as an "off ramp" of sorts where all can save face over some issue that potentially could be the cause of major embarrassment.

I am certainly not suggesting this is the case, but the political arena is one which is rather dimly lit and brimming with loveless marriages of convenience between sworn enemies.

Good theory. Could be he is getting more support in jail than outside jail so release him. Yea there is something else going on though, i doubt they want to assassinate him, seriously thinks so but i dunno, he might be onto something.

DJ any theory from your side?
