Johannesburg - The SABC was described as "distasteful, unacceptable and dishonest" in a scathing attack over the rights of its pensioners in the Rand High Court on Wednesday.

Judge Percy Blieden delivered judgment in the class-action suit brought by 93 SABC pensioners after the SABC suspended their medical contributions and cheaper TV licences in a "unilateral" way "without negotiating".

The groups of pensioners - including well-known personalities such as Cliff Saunders, Johann Pretorius and André Liebenberg - walked out of the courtroom victoriously.

The SABC was ordered to start paying 60% of the pensioners' medical-fund contributions with immediate effect.

The public broadcaster was also ordered to reinstate the TV subsidy to pensioners immediately.

Moreover, the broadcaster was also told to refund all the money the pensioners had to pay from their own pockets ever since the benefits were suspended, as well as the interest at 15.5% per year.

Costs estimated at R250m

The exercise is estimated to ultimately cost the SABC R250m.

Blieden said as a "state organ" the SABC is expected to act ethically, to practise good human-resources management, to be transparent with information and to act impartially, fairly, equally and without prejudice in its service provision.

"Unfortunately the facts of this case prove that none of the conditions were met by the SABC in its relationship with the pensioners.

"The mere thought that costs are curbed by aiming at the rights of pensioners with regards to medical-aid funding is not only distasteful but unacceptable and dishonest."

Conspiracy claims "scandalous and libellous"

Blieden also rejected an argument from the SABC that the pensioners conspired before their retirement to ensure that "white managers in the SABC" resigned with benefits to which they were not entitled, as "totally scandalous and libellous".

Piet Bester from the firm Blake Bester Inc, which acted on behalf of the pensioners, described the verdict on Wednesday as a "strong signal to all employers in the country that they cannot unilaterally and without negotiation" tamper with employee and pensioner benefits.

Folks, don't be shocked - this is par for the course. I have, over the years, worked for both public and private sector organisations, including large multi-national corporates, Government and civil society organisations. Other than in the civil society sector, I have not yet found a single organisation where ethical considerations play a role in decision-making, social responsibility stances notwithstanding. The worst of all is when you read the reports included with the annual results and financials published by some of these supposedly civic-minded entities - read between the lines and do some linkages between different statements made, and you'll see it's usually just a lot of hot air. This judgement is once again affirmation of the management incompetence and downright idiocy that is threaded throughout the decision-making layers of our society - what the hell are the universities and business schools teaching? If I was a conspiracy theorist, I would say some plot was afoot! Nevertheless, hats-off to the judge, for a sober and hard-hitting judgement, which I hope all decision-makers take to heart...
 
This does not surprise me at all. I'm pleased to see that justice was served.

Update.

Just read the Sunday Times Letters Page. A letter from Cliff Saunders was published today entitled "You Miserable Marshmallow". Seems old Cliffe is not only peeved with the SABC and being shafted by them, but he has taken a scathing attack at Martinus Van Schalkwyk in his letter. I wish I could post a copy of the letter here. It's good reading. Hmmm, makes me think I need a typist. Erm, RPM, does Moderator Status allow us to employ a typist? Hehehe.

You miserable marshmallow

Thirty years I spent working as a journalist for the SABC ('propagandist' for the National Party, and I readily agree that in some of what I achieved I have much to be modest about), but when I watched NNP leader Marthinus van Schalkwyk conclude his traitorous path into the fat-cat bosom of the ANC this propagandist was without words, "Kortbroek joins ANC" (August 8).

Ten times I recited the karate dictum of "character, sincerity, effort, etiquette and self-control" but it helped not a bit: never have I so badly wanted to don my canvas suit and black belt and foray out there to mangle that miserable marshmallow and then sentence him to a lifetime of being a tourist guide for loud-mouthed Americans and inscrutable Japanese.

This manipulative, self-serving individual has made a mockery of the party that supported him in his campaign to achieve a Cabinet post in Environmental Affairs and Tourism which ensures one thing: he has no significant influence on any important political decisions made by the ANC - except to decide where the next beach should be for the banning of 4x4s.

By joining the ANC this midget Nat marshmallow has caused his "party of oppression" to disband - only to join and strengthen the ANC "party of oppression".

He is sitting pretty in various first-class flights to various exotic destinations, while thousands of unemployed Afrikaners/whites flee the country in search of work, or simply stay here and suffer.

Please SABC: parade as many Cabinet ministers as you wish on the TV screen, but keep the Van Schalkwyk visage out of my face. - CLIFF SAUNDERS, Northcliff
