Sanral: E-tags won't be compulsory

Johannesburg - Motorists are not obliged to buy an e-tag to travel on Gauteng's roads, the SA National Roads Agency Limited (Sanral) said on Tuesday.

"Sanral would like to clarify to road users that it is not compulsory for road users to buy an e-tag for Gauteng e-tolling. Registering with an e-tag is optional," it said in a statement.

It was reported earlier that Sanral was attempting to legally force motorists to buy an e-tag or have their driver's licences taken away.

"Road users are therefore not forced to buy an e-tag, but are encouraged to obtain one to enjoy the cost saving benefits available to e-tag users."

These benefits included a 48% e-tag discount and a frequent user discount.

It was reported that draft changes to the National Roads Act Regulations - pertaining to e-tolling - were submitted to a few parties late last week with a request that comment be received within 20 days of publication.

If instituted, it would give "peace officers" the power to stop cars and demand to see a driver's licence and to produce any other tag or document they were required to have.

The Democratic Alliance said the regulations sought to give Sanral CEO Nazir Alli the power to appoint his own police force to ensure toll compliance.

"The regulations allow the CEO to appoint peace officers who will have sweeping powers to stop, search and confiscate any document found in the vehicle, including drivers' licences, at their sole discretion," said DA transport spokesperson Neil Campbell.

"The legality of summarily confiscating a document, required by law to be in a driver's possession, must be tested," he said.

He said considering action had been taken against the tolls in court and with the National Consumer Commission, the legislation could be considered an act of desperation to intimidate motorists into accepting this unjust tax.

"At the very best the draft is an overreaction to the toll dilemma which Mr Alli and the minister have created for themselves. It's appalling to create a police force merely to enforce unjust taxes," said Campbell.

The inclusion of the word tag in the amendment bill is incredibly telling.
 
The powers these "peace officers" will have is unnecessary... especially for people who are not trained law enforcement officers (and even them I'm wary of letting into my car or property)
 
Powers of employees contemplated in regulation 2(2)(a)

3. An employee appointed in terms of regulation 2{2)(a) may, subject to the Act or
any other law may-

(a) demand from any person immediately to produce a licence, operating licence
permit or any other document or authorisation authorising him or her to drive
or operate a motor vehicle, and to produce any other document or tag which
he or she is required to have in respect of any motor vehicle in terms of the
Act or these Regulations, or the regulations on the exemption from payment
of toll promulgated in terms of the Act, or any like document issued by a
competent authority outside the Republic, and question any person in relation to
any such tag, document or equipment;
(b) impound or confiscate any document or tag referred to in paragraph (a) which
appears to be or which that employee suspects to be invalid or which has
been or appears to have been unlawfully altered or defaced or which is being
put to unlawful use, and where any document or tag is so impounded, the
employee must issue a receipt in respect thereof to the person concerned;
(c) impound any licence, document or tag produced to him or her in terms of
paragraph (a) which in his or her opinion may afford evidence of a
contravention or evasion of any provision of the Act, and where any licence or
document is so impounded, must issue a receipt in respect thereof to the
person concerned;
(g) at any time enter any motor vehicle and inspect such vehicle and any
electronic device installed therein for the purpose of toll collection;

(h) question the driver of a vehicle as to whether required tolls have been paid;
(i) issue a receipt if any tag, document or equipment has been impounded or
confiscated under paragraph (b); and
(j) deliver such tag, document or equipment which has been impounded or
confiscated under that paragraph to a police officer to be dealt with in terms of
the Criminal Procedure Act, 1977 (Act No. 51 of 1977).

(2) Where such an employee reasonably suspects that there are outstanding tolls
or other surcharges. fees, fines or penalties payable in respect of the Act in
respect of any vehicle, he or she must inform the driver of the vehicle that-

(a) all outstanding tolls and other amounts payable in terms of the Act in
respect of the vehicle must be paid;

(b) he or she must not continue to use the toll road if he or she does not
make arrangements to pay those tolls and other amounts; and

(c) if the person disputes such tolls or amounts, that employee has issued
to the person an invoice setting out the tolls and other amounts and
instructing such person to contact SANRAL to resolve the outstanding
tolls and amounts.

Quick question, but with all this e tag bull****, why do we pay for taxes on petrol and why do we have to pay for license disks for our cars? Doesn't this money go towards the roads, or let me guess...the government steals that money and now trying to make a new way to once again steal our cash?

that is it. But we still have educated people telling us that they are not corrupt and will vote for them again the coming elections.
 
Don't fall for the SANRAL propaganda. We'll see a lot of this misinformation in the next couple of months.
