SARS rant - yes, what's new?!

I doubt we owe them that amount ... they may not be stupid, but they definitely are DISORGANISED AND INEFFICIENT if they give tax clearance and 3 years later they discover they are being owned.


Oh and by the way they are most definitely unfair!! We have had instances where they made mistakes and then chalk it up to human error ......... yet the taxpayer is not allowed to commit human error. Ridiculously unfair.

did they refund you after discovering the error?

Oh yes they most certainly can. Its a fairly recent thing though since like 4 years ago.

I was overdue on tax and they asked me (and penalized) me ... but I guess I didn't have the money, so there was nothing they could do :P

It was not that kind of error. I applied for tax clearance, they gave it and subsequently "discovered" that I owed them R24K for PAYE from 3 years back. When I queried as to how they could have issued the tax clearance when there were outstanding taxes, they said it was human error on their side - the tax clearance should never have been issued.
 
I saw advertising the other day for a US company that gets back tax from the IRS for you if you send them the details of being screwed in tax.

South Africa so badly needs something like this but without the SARS processes to claim back unfair treatment the public gets screwed. I wish SARS could get audited as it is the middle class paying PAYE that are open to get screwed the most with inadequate and biased SARS processes

they would have pursued you with equal fairness if the mistake had been on your side
 
SARS isn't unfair.
If you owe the tax; they will collect - but that doesn't make them wrong

Classic response from someone who hasn't owned a business and actually worked with them.

Scum would be the most appropriate response. They know they are guilty but they'll try their luck anyway. Mostly to "test" if you keep your records

SARS employees are really vindictive, if you dare suggest they aren't doing their job they'll go ahead with whatever "accusation" they've made regardless if they know you are not in the wrong.

Are you 100% sure they are correct about that?

FYI if you owe them money they appoint the bank as their own personal tax collecting agent (part of the Tax act) and take the money from your account without even letting you know.

Took my Mom over 1 year to collect ~R150k. We had to go to court, thereafter at least they had to pay it back + 7% interest.

No I am not 100% sure but that is my auditor's job and she seems to think that we do owe those monies.

You can't pan the entire organisation because you have had issues with a couple employees.
They are very efficient at what they do, which is collecting tax. Probably one of the top parastatel-type companies in the world.
Your priority is the best methods in which to avoid (not evade) paying tax, theirs is the best methods to thwart you.

Yes, they are good at filling the coffers. Best functioning department ....... now, if only the ones RENDERING SERVICES TO THE CITIZENS were good too, we would feel so much better!!!

We've never avoided tax. It is their incompetence that is the problem. More importantly they blatantly try to break the law and steal from the citizens of this country that try to build it up by creating jobs.

They make accusations and then expect you to do their homework for them. Which is they want you to PROVE your innocence, and when you do they'll call you back days later with the exact same accusation because "Oh no no no no, I waz not infomed, it is not in you file". Typical.

My personal favorite is when they try to get records and taxes for years past which they may legally request them (eg. they may not request paper work for taxes over 5 or 8 years or something). They tried to tax us for 15 years ago. As soon as you confront them with the relevant legislation: "OOOHhhhh ok, bye". That person knew it wasn't legal but just tried anyway.

Pathetic employees and work ethic just like every other government run department. They are like the traffic police, constantly using unethical methods to collect monies because their bonuses depend on how many honest citizen they were able to defraud.

You are either ignorant about how tax in SA works or you works for SARS, probably the latter. In which case, WAKE UP!

I'd go shopping for another auditor IMHO. Mom had a fellow who was the same, he always "thought" that we owed whatever SARS asked. After they came with another R100k that we supposedly owed us went to another auditor who set everything straight.

When they took the R150k from my Mom's account they fought the battle to get the moneys and eventually went to auditors council or some such as that.

Think we are marked now tho because every month they have a new story of monies owed to them and each time it is, as usual, fictitious.

Huh?? Of course it is my auditor's job to make sure I pay the correct amount. But how in heck can she stop SARS from claiming crazy amounts -that's not her fault or her doing at all !
 
I think Gnome meant that if she was your auditor when the under payment occured, she should have seen it then....

SARS alleged it was an underpayment .......... but was it really???? And why did it take them 3 year to figure it out??
 
understood, but your auditor now seems to agree with SARS....
