I dont think so, the guys have been taking advantage of this little cluase, e.g. Mustek with their Mecer Plasma screens, they sell it as a "monitor" however it is actually a TV.

Imagine the margin they have been making on these things.:eek:

SARS can raise an additional assessment within three years from the date of the original assessment if the taxpayer made a correct disclosure and SARS was at fault.

If the taxpayer's declaration contains any misrepresentation (deliberate or non-deliberate) SARS can reopen that assessment anytime between now and when hell freezes over.
 
next thing you know SABC is gonna pitch up at everyones house and demand late payment fees, etc for having a monitor.
 
I can understand if the device only has s-video and/or Pr/Pb/Y inputs or perhaps those in addition to a standard 15-pin D-sub computer input, but surely DVI is also a standard data input?
 
No doubt the importers were sneaking in stuff under the cheaper tariff heading, now they whine when caught. Shame. They could have applied for a determination at the time.
 
This is just silly. Truly silly!

I wonder when government will pay us citizens compensation for being raped by Telkom for so many years? I know this doesn't relate, but when I see government getting greedy I always think of how we suffer under Telkom.
 
I don't see a problem. They can cry when taxes go up, but not for back-dated taxes. Hell, SARS piled a bunch of back-dated tax onto my dad some time back too (No, not for tax evasion). If SARS has a legit claim to it, then STFU.

However, it does look like they brought in the heavy artillery for this dispute.

I agree.... but only for a legitimate reason... you wouldn't like it if SARS decided to remove certain taxable deductions, and then apply the new system going back 5 years... i.e. you owe them money .
 
Don't see how SARS can justifiably backdate it. Why do they have to slap so many duties on everything anyway? Just makes it even more expensive for those of us that already pay taxes anyway. :mad:

If the importers were pulling a fast one with tariff headings, as they probably were, SARS has every right.
