We Need a SARS Stickey :(

My question. Was my work not suppose to register my me at SARS
( I have no Idea how this works none at all. ) I went to a tax consultant that was suppose to help me, now I receive Non Submision penalties :(

No actually they register you as a tax contributer, you must register as a tax payer. 2 different registrations... hence IRP5 and resubmitting tax documents. Your company is only responsible for the PAYE, not all your other stuff!

Your work is not meant to register you as a taxpayer.... thats your responsbility.

You have 5 years to do it iirc.
 
You are registered with SARS if you recieved Non Submision penalties.
It's the IT12 returns that you yourself have to submit that are outstanding and thats the reason for penalties.
If you receive less than R120,000.00 from one employer only, you are not required to submit returns.
If you receive more than R120,000.00 or had more than one employer or have other income example rent, you are required to submit returns.
Best advice is submit all outstanding returns and do a remission of penalty request on e-filing.

I tried last year but I did not have an IRP5 Number. And none of the numbers on the IRP5 worked ( I tried everything) I therefore thought that I did not have to ( I also asked questions and asked people and it seems like our Tax people know less than me ), this year I had a number and I registerd.

Go to a SARS office with your ID and ask them if you exist on their system.
Take the communication about the "Non Submission penalties" along. Their might be some reverence numbers on it.
 
The reference number on the correspondence regarding the "Non Submission penalties" is your tax number.
Register on e-filing, submit outstanding returns and do a remission of penalty request.
70% of the time they will remit the penalty.
Just think of a good excuse. Something along the lines of you did not know you were required to submit a return or you earn less than R120,000.00 from one employer and are not required to submit a return.
Or get a tax consultant to help you.

I think I's my company screwed up. Somehow I earned more in 2009 than 2011... If so They sure as hell owe me money :D

I'm online with sars now... and they can not help me. :(
 
One year they inflated my income by R50 000 and the next they deflated it by R50 000

The deflated amount is less than R120 000 But I have to pay penalties.

I like getting my salary cash. I'll stash it in my mattres.
 
Sheesh. Sounds like your payroll department might have messed up.
Remember SARS system do not know that you only received the amount which is less than R120,000.00. You might have had other sources of income as well.
If you only received the amount that is less than R120,000.00 for the year, you will have stronger grounds for the remission of penalty and it will most likely be reversed.

Would also like my salary in cash and stay of SARS radar but they are making that near impossible now a days.
If you are struggling to much with this and SARS, it might be worth your while to have a reputable tax consultant assist you.
The incompetence at SARS is only surpassed by their eagerness to collect money.

sorry if i'm not around much these days but i am really busy.

would it be a problem if i left my email address here for people to get hold of me. that way i would be able to answer via email instead of people waiting for me to come to the forum.

you can activate the email future( allows people to email you from your profile)

or alternatively set your profile to email you when people PM you (can avoid the crazies)
