Please assist if possible.
I know this is not part of a Domain Dispute Discussion, but I am desperate.
I own the domain
www.simplesmartinsurance.co.za - Not parked, the function is to generate leads online to sell to Insurance Companies.
Dial Direct has submitted a complaint claiming that they own the rights to "SIMPLE SMART INSURANCE".
I thought that they had no case due to "SIMPLE SMART INSURANCE" being a non distinctive phrase in the common English language.
Well, the adjudicator ruled in their favour and I have been ordered to transfer the domain.
Surely this cannot be correct?
** Additional info - Dial Direct has registered a trademark "DIAL DIRECT SIMPLE SMART INSURANCE".
The opinion from a respected law firm was that they were not allowed to register Simple Smart Insurance on its own and thus had to add Dial Direct.
Since this registration, Dial Direct has not shown interest to register the domain, now they state that I am benefiting from the payoff line.
My intention was not to sell this domain to anybody, but now after a lot of legal bills that ended up in defending my self, I have to give up the domain for nothing?
