Looking for some sectional title advice- bought a house recently which is a sectional title. Was a single house which was split into two freestanding properties 50 odd years ago. Unfortunately it was our first house and didn't really know what we were doing so we signed without understanding everything first.
Issue is that the double garage is on our property, so that and the driveway are deemed common property. So the neighbors use our property to park and then go next door.
There is also no body corporate since it was dissolved many years ago.
Now we want to know exactly what rules should be in place regarding parking etc. We got a pile of body corp documents with the house from the 70's, but the body corp hasn't existed for years. The properties are labelled as 1 and 2 on the plans, and there is a 1 garage and a 2 garage, but besides that we never saw any other documents outlying rules around sharing.
We've become unhappy with the way things are, since the neighbors have access to our whole property at any time, park multiple guest cars when it's a very small driveway, park on our property etc.
Has anybody seen a situation like this? Seems tricky since it's not a typical complex or townhouse sectional title, and no body corp.
