Hi all
So at our recent AGM we had a SECRET ballot to decide on who the trustees would end up being.I just queried the amount of votes in an email to the building administrator as the votes didn't add up.and the building administrator to clear up the confusion just posted how everyone voted in the secret ballet. WTF.
We have been trying to get rid of this corrupted building administrator for years.Is her sharing how everyone voted without our permission to do so something we can go after her for get her removed from her post and get a honest person in.
Please say yes we need to start getting a win at some point.

My BC trustees have had the same chairman for 11 years. She actually does nothing. Very good at delegating. The caretaker's flat has been vacant for 4 months as he left on 30th November

She s supposed to inspect the flat (not done) and interview caretaker candidates (not even placed an advert). Meantime the swimming pool turned green, one of the gate motors only works when there is mains power, someone stole a number plate from the lift call button and 4 cameras have been vandalised

CCTV power comes from the ex-caretaker's flat and electricity ran out in January.

When challenged about this, we get a 15 minute tirade about how busy she is, she is a working woman, has much more expertise than any of the other trustees

At the (ZOOM) AGM in December, there was an item on the agenda about electing trustees for 2021 and appointing a chairman. This item was simply bypassed. When 3 people objected to the item being left out, she ended the meeting

Two of the trustees wrote to the Managing Agent. The result of this was a lawyer's letter to these trustees advising both of them that their services are not required as they bypassed BC rules

A CSOS hearing has been arranged for 14th April. She has already advised that she cannot attend. But it will go ahead regardless

What rules? were they charged for the cost of the letter?

um, as per the Act trustees are appointed (basically nominations confirmed) at an AGM.
The trustees then vote for a chairperson (usually a separate meeting)?
How is it that the (general) members voted for a chair of the trustees?:oops:

What exactly can Csos do against a chair abusing there powers or a building administrator playing fast and loose with the sectional titles act.
 
CSOS can recommend the Chairman be dismissed.

There is a ST lawyer, Mervyn Shevelew who has recommended a course of action. The Managing Agent spoke to him and he told them that this conduct will not stand up to scrutiny

The current chairman announced the 2019 AGM during the afternoon, 3 hours before it was to start and notifications were only received the following day

With the 2020 AGM taking place via ZOOM, there was sufficient time to get people to attend. However, when someone was speaking, she muted them and when they complained, put them in the Waiting Room. When several complained at once, she ended the meeting

About a week after, we were told that the recording did not work. I offered to host the next ZOOM meeting since I have an account. She says this is irregular, Mervyn disagrees
 
moblise other owners, call a Special agm then vote her out of being trustee, the new comittee can then meet and elect a new chair. if managing agent is together with her you can kick them out together with her and get a better one.
sectional titles usually have a lot of politics so its about numbers, if you can convince majority of owners then you can control the scheme to do what you believe is right

Hi .At the beginning of an AGM you should be asked if you want to vote via a show of hands or with a voting card.We had opted to vote via raise of hands until it came to the trustee vote. .At any general meeting of owners of sections a resolution put to the vote of the meeting must be decided by a show of hands by the persons present and entitled to vote at the meeting, unless either prior to or on the declaration by the chairperson of the result of the show of hands, a poll by means of a secret ballot is demanded by any person entitled to vote at the meeting.
