Jackie Selebi moves against the NPA
702 Eyewitness News can exclusively reveal that National Police Commissioner Jackie Selebi has launched an urgent application in the Pretoria High Court.

It's understood Selebi is trying to prevent the National Prosecuting Authority from proceeding with any prosecution order against him.

Speculation has been rife for several weeks now about Selebi's imminent arrest - on charges relating to his alleged involvement with the criminal underworld.

Selebi's legal team served papers on the NPA this morning. However, he is bringing the action in his personal capacity.

Eyewitness News can confirm that Selebi has launched the urgent application because he wants more information about the charges the NPA intends levelling against him.

Sources have also told 702 that Selebi’s legal team will argue that the NPA has an ulterior motive and as such, should not continue with the prosecution until it can provide him with more details.

This, he says, will give him an opportunity to respond appropriately.

Selebi claims that despite several requests for this information - it has not been availed to him.

It's understood his team will argue that there is malice involved in the NPA's investigation into his activities.

His team will make up to 20 requests of the court on the matter.

Selebi is expected to appear in court at 10 o'clock tomorrow morning.

In three years time he is going to complain that his trial will be unfair as the NPA took too long to get to trial by dragging their feet and being malicious. In the mean time it is he who started the delaying tactics. Hmmmmm - De Javu :p

If you got nothing to hide, just go to court and you will win - whats the problem.:confused::confused: - Oh I get it now "IF" you got nothing to hide. :p:p

of course they do, just like the SAPS has one on Nel. This is getting silly. :(

Exactly right - the fact that NPA is trying to prosecute him is just revenge for the SAPS arresting Nel.

Oh wait, the NPA has been investigating for a bit longer than the last two days.

Selebi is in court today, he says Bulelani Ngcuka, is still running the scorpions and is out to get him

He also says that if he is charged, it would be detrimental to the security of the country, and that they should give him time to put a replacement in place, then charge him

I would rather have no-one at the head of the Police than a mob afilliated commissioner ( made guy )

What is it with these high-profile people and their "urgent court applications" to have charged dropped against them?? It's either that or some lame comment about "the charges being part of a plot" against them.

Geez, if you are not guilty, then why all the fuss. Sue the NPA for wrongful arrest, inconvenience, etc, after the fact.

Gerrie Nel hasn't done anything like Selebi. Perhaps he is guilty or perhaps he wants the law to run its cause?

If Selebi is guilty of fraud and corrupt relationships with criminals (I'm not suggesting he is), then this will have some serious implications in the way SA is viewed by the international community, especially as Selebi heads up Interpol. I don't think the government quite grasps the seriousness of this situation.

So if he is guilty, should he be left alone, because of his position in Interpol, and the damage it could do to us internationally, imagine what the world would think of us if we did that, not to mention the implications for the security of ordinary South Africans

BTW - He is the President of Interpol, a largely ceremonial function, the real head of Interpol is Ronald K Noble, the Secretary-General

The Secretary General is effectively the Organization’s chief full-time official. He is responsible for seeing that the day-to-day work of international police co-operation is carried out, and the implementation of the decisions of the General Assembly and Executive Committee.

As President of Interpol, Selebi chairs three meetings of the Executive Committee, each year, and opens the annual General Assembly

If I think back to the time when Zuma was charged with rape; did he just go to trail and let the law run its course or did he also try to contest the charges beforehand?

I don't remember that he contested it and in the end he was found not guilty. He did however contest his corruption charges, just as Selebi contests his charges. Perhaps this could be a pattern?

AFAIK, Zuma only contested the charges after he was served / charged - Selebi has not even been charged yet - he wants to stop the NPA from not only arresting and prosecuting him, but also to stop investigating him, and he wants details of the investigation.

If he wins, this could set a dangerous precedent, in that investigating agencies, would have to tell criminals that they ae being investigated and give them details of the investigation.

There are also the rumours that the Scorpions will be disbanded, what happens to the files once they are disbanded ?

yes, this sounded too weird to me, how can you go to court to get a get-out-of-jail-free card. Didn't even know that existed. Altho nowadays anything is possible...
So then other criminals can also go and get the immunity necklace?
If the dude's innocent then he should let the law take its course, and accept treatment under investigation just like u and i would be.

Well it made the headlines on BBC World tonight. There was so much for the reporter to say about the arrest warrant, the charges, his links to Agliottii, his position as commissioner, he had trouble summarising it accurately! :D

'Jackie Selebi must go'

Maybe there is some justice left in this National Circus.

They should put Bushy Engelbrecht in charge and with both hands tied behind his back he would do a better job than the lot of them.

Now you talking although there was that incident where "fingers" rabotapi? was murdered while in cuffs. Remember that? I think he was killed on purpose to protect some gvt guys.

Can't say I do.

Mbeki, whoever, just needs to appoint someone already within the Police Force who has the necessary qualifications and experience. Bushy just came to mind.
