Good day everyone
I have a question? I sold my bakkie and it's two years now and still struggling to get my money from them. They pay whatever they feel like and it's been 3 months no payment. We sign an agreement which state that the bakkie is only there's when last payment made and papers will stay by me till the . The car is still mine. What can I do now cause I'm fed up with them. I gave them so may changes already and on top of it I think they sold my bakkie. Do I have the right to go fetch it. Does it matter how much they paid already cause I'm prepared to pay them back the way they paid me every month. Help please
 
Eish. Selling something by definition is a transfer of assets in exchange for money or other compensation. By definition you didn’t sell anything. Sounds like you gave a stranger the right to drive your car, and they send you some money whenever they remember you. Now you made your bed and you gotta sleep in it.
 
No we signed an agreement document. In there everything is clearly and I still have the documents of the bakkie. He only got a copy of the agreement we signed

I don’t know how people can be so careless, if the the bakkie was used in a crime, Op would be liable, Op would be liable for all traffic fines and tickets etc. Man people really do lack common sense in this country.

Someone who can’t afford to buy your car outright is now defaulting on their payment arrangements, even though it was all in a signed agreement document? And you’re surprised by this?

Something like over 50% of South Africa’s credit active population are defaulting on their debt. The only faith you should have in a piece of paper is if it has a picture of a cheetah on it.

Only enter a deal like the one you did if it’s a family member or a friend you really want to help. For a random stranger … I just don’t see the benefit. Now you have a fight on your hands, and you’re asking for advice on an internet forum.

So if I use your car and commit a crime you're going to jail for it? Lol

Also, if someone else used your car and you receive a ticket or speed fine

I also remember fines in CT used to have a form at the back where you could nominate the driver. Haven't received a fine in years, so not sure if they still have the form at the back.
 
Hey guys I just want to know. Can I go fetch my bakkie. What are my legal rights please. Anyone out there can u answer me
