7.3 Services are used at the customer’s own risk and Sentech
makes no warranty and or guarantee that the Services will
meet the customer’s requirements, be uninterrupted,
complete, timely, secure or error free, nor in respect of the
subscriber apparatus or its suitability for any purpose
whatsoever. Although advised that the customer is in a
coverage area, there is no guarantee or warranty given
against interference and/ or in respect of the use of the
subscriber apparatus;

Just had a Thought

Seeing though we are all getting SCREWED...... Maybe we should all club together and buy a case of VASELINE (Hey thats all we can afford - anal lube is way to pricy) and ship to HQ with the bottles having a complimentary label on them......

And then if anyone goes to meetings with them, take a bottle with, open it up and place it on the Desk and just state that you brought it along to ease the PAIN.

On second thoughts we can attach condoms as well so as to reduce the spread of AIDS!!!!!

Thought so too....had 12K for about 15 minutes the......... was struck down by AIDS (Atrocious Internet Download Speeds) and back to 2K

I suppose thats why we need vaseline ALL THE TIME......NEVER know when they are going to "STRIKE"

Just got back to my machines and saw that my firewall had rebooted due to little fingers having played with the wall plugs.

Started things up again, and happily saw an initial tucows.is.co.za download speed of 10K/s. Only to see it dropping down to the usual dreary 4.5K/s after about 20 seconds.

The problem is that any contract is as binding as you are willing to contest it in court.

Sentech could offer the friendliest contract you could imagine. But when you want to cancel, they can just start to send you nasty lawyer letters and take you to court for what ever reason they can think of knowing pretty well that they have more money to waste on lawyers than you have.

I've consulted for a legal firm - I saw what was happening!

I lost all my respect for the legal profession witnessing the way in which the law is twisted to screw the other party and get fees from your client.

Remember not everything that gets put on a legal document will stand up in court.

If for example you sign a contract that states that one party (employer)can give another party (employee) notice to end your contract without reason. That will never stand in court (and it didn't). This is for Labour contracts and there is no reason why it shouldn't count for other applications. The fact that you signed it doesn't bind you as cast in stone.

Another thought

I seem to recall Telkom had the same print on their site regarding ADSL. It's a beta service and they will not be held responsible if it fails. My logic then tells me that all the ADSL people are beta-testers [;)]

That's true, but the problem is that you have to go to court to find that out, and very few 'normal' people can afford that financially.

This "fine print" essentially states that Sentech do not even guarantee that the product works or is usable at all. Somehow I'm pretty sure it wouldn't stand up in court if the product really didn't work, as you can't legally sell someone something that just doesn't work, nor is it in line with anyone's expectations when signing any contract, no matter what the contract states (especially since the product worked well in the trial phase and in the beginning). However it's probably fuzzy here because Sentech's product does basically work, it just works badly (i.e. the speeds are very slow). Still, a two-element heater with only one element that works is still BROKEN, and no vendor would try argue otherwise even in court, and even if the terms of sale stipulated that the heater "might not work fully". Sentech's product is like a two-element heater with one element almost permanently not working, and the only only about half as hot as it should be most the time. If I were feeling negative, I might think that Sentech planned to do this from the start (i.e. not provide enough bandwidth), simply due to the fact that they (a) made sure to put in so much fine print and have a more draconian contract than any other ISP and (b) made sure to point out on their website since the start that it's a "shared service" and (c) since the speed problems began the call center have been using the "shared service" thing as the primary excuse for bad speeds; these facts kind of make me suspicious, as if they knew all along it was going to suck. Makes you think, at least.
