My wife works for an attorney, reads contracts like this daily and recons they have covered themselves to the extent that if they went bankrupt and you lost service you would still have to pay till the contract was up, We are gonna be hard assed, going to send a fair corrected contract 2 them with a covering letter stating that if they accept our ammended terms and conditions we will be happy to do business with them. I will make the ammended contract available to others who wish to get mywireless, my mail [email protected], I urge everyone who does not want to be bound into a 1 sided agreement and wants broadband to fax the revised contract and covering letter to sentech, the only way to stop ur self being ripped off is by not signing such an agreement, I also hope ppl with mywireless will also send letters to sentech expressing concern over certain points in the contract........eg section 12.
 
p.s. sentech needs ur money to make mywireless survive, u don't need my wireless to survive. We might be forced to pay high prices for broadband but that does not mean we need to give up our freedom of choice
 
We tried something similar spotted - and were shown the finger as answer ;-)

Their legal department is either huge or incompetent - took 4 weeks and then it was announced that it's been misplaced ;-) They were not willing to accept ANY changes to the standard contract. If you get an ammended one accepted I'd really like to give it a read ;-)

Im sure they can deal with the loss of one customer. At least, this is their view. In the end, if you want mywireless, you gonna have to bend over like the rest of us. Or use the alternative. Thats pretty much the way things are in SA. Hey, if you do manage to speak to them about this -- make sure you mention our forum and some of the key issues we have raised. Good luck with that.. It seems Sentech keeps a very low profile.
 
I remember getting very mad with Sentech while ordering the service. They are so invasive, don't these people know that as soon as you start DEMANDING personal information (even if from a company) you get people's backs up?

Personally, and I am speaking from LIMITED law experience here, so please bear with me and don't come down on me like a ton of bricks if I am wrong, but if Sentech did go bankrupt, the contract would become unenforceable (paying for something you're not getting), and would fall away. They would only have a very weak leg to stand on in a court. IMO, there are two parties to a contract: you pay for service, they must render it. Remember: the law is there to protect individuals, but it is subject to abuse. And I believe that Sentech has abused the law, and that wouldn't count in their favour in a court.

No amount of ass-covering by sentech could allow a customer to be abused to the point that we pay for nothing because of, say, bad management, leading to the collapse of mywireless.

Having said all that, Sentech probably (definately) will not allow an amendment to it's contract. You don't HAVE to use MyWireless, they don't HAVE to accept your amended contract.
 
I hear you, but they are covered for any loss of service, an attorney will read it on friday so I should get the full run down of the contract by fri night, I will keep you posted.

1 person can't hope to make a difference thats why I am appealling to everyone wanting my wireless to send a ammended contract that is fair to sentech and the customer, If enough ppl do this it might make a difference

p.s. it even says in the contract if you sign it you may not take them to court, ie, for some reason u don't get service for a period, you want to go to court to cancell the contract as the service you are paying for isn't working, bad news u can't, u just have to live with it..........I have had problems like this before a real pain in the ass
 
Well, if the service stops, my payment stops.

If I wouldn't be able to take them to court for no service, they cannot take me to court for non-payment. At least, that is what I feel the law would say about it - as I said before, the law is fair and seeks to protect everyone equally.
 
Section 11.5 is interesting...

11.5.2 is extremely intersing, as some of us have had Horrible service for 40days(not yet 60) or more.

This is purely out of an idiots POV...I have never known anything law wise, and seriously dont normally care about it.
 
As a thought, maybe those open job tickets from those of us who have been having lengthy periods of lousy service, are technically evidence that service has been effectively 'interrupted'..
Perhaps folks should quietly ask any connections of theirs inside Sentech callcentre, for a quiet email of a copy of their longstanding job tickets - as it proves a lack of service for a period of time..?
 
Anybody know about contract terms or costs proposed for the following, saw it on the nowire website :

Keeping a log of your own tickets is not a bad idea. I started doing that after about the 5th ticket I opened, with the ref no and the date
 
Hey donovan, read the contract, you clearly sign that u may not take action against them and they can take action against you...............scary

Another scary part of the contract..................the first couple of lines in bold type
 
Section 11.5 is interesting, just gotta prove it and hope they give you 7 days notice.........I also don't know much about the law but I am studying an LLB part time just so that I can understand contracts before I sign them.........will take 10 years till I will know exactly what is happening
 
There are at least two sections of law applicable here: Contract law and Common law.

Common law would give you lots of leeway regarding "no service, no pay".

You could also countersue them civily and lay criminal fraud charges aginst their CEO should they start pulling extreme stunts like stopping service half way through your contract.

PS: I walked out of my 24 month Infosat contract with Sentech due to poor bandwidth allocation [8D]
 
www.wdsl.co.za offer very similar services to Sentech and dont have any contract requirements. Only thing is, they are only in Cape town....
 
Hey all, whats happening, After waiting for a reply for 2 weeks I finally get a few in one day, someone's been whipping there orcs :)

My wife boss read the contract 2day, his reaction, DON'T SIGN!!! [:(], I have asked my wife to get him to mark everything that he disagrees with so hopefully that will come soon, I really want mywireless but not with the conditions attached.

I mailed there legal dept today and I am just waitng for a reply

I am interested in obtaining mywireless, before signing any contract I get my attorney to read it and give his opinions. He has advised me against signing the contract due to certain clause that he feels are unfair and that I will have no legal recourse if for instants there is bad service on Sentechs part, lack of signal (not getting the 128K I am paying for), no definite warrenty on the modem, etc,etc. I have no problems with signing a two year contract as long as it offers me and the company some protection which I feel your contract does not.



Would it be possible for me draw up a new contract that would cover myself and Sentech and submit it for your approval, once it has been revised and both parties are satisfied I will glady bind myself to a two year contract with Sentech. I have been on a forum called www.myadsl.co.za/forum and there are quite a few people who are holding back from using mywireless due to the contract and others who feel a bit let down by the service after they have signed it and do not have any leverage.
