So Eskom toke my app down from google play...

Reason: copyright and In terms of section 77 of the ECT Act, and Eskom’s conditions online I am currently taking all unauthorized apps in the Google and associated stores to avoid bringing Eskom’s reputation to disrepute. [email protected]

I know my app wasn't the best, was working on rewriting it completely without the ads. But at least the tweets and schedule was accessible on it.

It was downloaded 7667 times since 28 November 2014, so some people fined it useful.

Wonder what reputation this Kenny is speaking about...
 
I also wonder as they already have no reputation at all. Stupid morons!


What did your app do?
 
It listed the latest tweets from eskom, and then the app toke you to Eskom's website to try to load your schedule without going out of the app...purpose was trying to have everything in one place...
 
Eskom have brought themselves into disrepute. No point shooting the messenger

Thanks, will remember it in the future. But I'm concentrating now on other stuff, was a good learning school :D

And I am also using the Eskom app that is linked in your signature now! ;)

These ass wipes obviously think they are the bees knees , sabotaged the country with their incompetence .
Every single one of them from manager up should be fired .
 
Hey Eskom, generating electricity is thaddaway. Not that you'd know of course, but try doing the job you're paid to do first before messing up something else too.
 
At OP - I would challenge this. As long as your app is not defamatory and since Eskom is a state-owned-enterprise one can argue that load-shedding information is public domain data. Since you are using Twitter data (publicly accessible) you are not violating any terms and services. The only thing Eskom can challenge you on is the use of their logo which you can replace with just a simple text "Eskom" logo (then again, as long as you are not saying that this is the "Eskom Official App" etc, there should be no reason to use company logos as long as the average user is not misled)

As of late I happen to know the ECT act inside out and the quoted sect 77 is bull**** as it just highlights what needs to be submitted for a take-down:

77. (1) For the purposes of this Chapter, a notification of unlawful activity must be in writing, must be addressed by the complainant to the service provider or its designated agent and must include-
(a) the full names and address of the complainant;
(b) the written or electronic signature of the complainant;
(c) identification of the right that has allegedly been infringed;
(d) identification of the material or activity that is claimed to be the subject of unlawful activity;
(e) the remedial action required to be taken by the service provider in respect of the complaint;
(f) telephonic and electronic contact details, if any, of the complainant;
(g) a statement that the complainant is acting in good faith;
(h) a statement by the complainant that the information in the take-down notification is to his or her knowledge true and correct; and

(2) Any person who lodges a notification of unlawful activity with a service provider knowing that it materially misrepresents the facts is liable for damages for wrongful
take-down.

(3) A service provider is not liable for wrongful take-down in response to a notification.

Do you mind posting the URL of the Chilling Effects TDN which Google would have sent? I personally would file a counter notice with Google Apps (without changing anything) (https://support.google.com/legal/tr...roubleshooter/1114905?rd=1#ts=1115643,1115791) and referring to that the information is public domain and no copyright has been infringed as the the information is equally available online and you are not using proprietary Eskom APIs.

I understand that you are busy and might not have the time to do any of this and in this instance, maybe Github your project so that anyone else can resubmit. For me it is a principle that a government should not bully citizens.

MagicDude4Eva, you are right in saying that I don't have time for this and should challenge it. But at this stage there are Apps out there that are better than mine and my feeling is its just not worthwhile (time and effort) to challenge Eskom/Google Play about this. If this app did bring in income, then it was a different story, but it was a free app and I did it as a service.

But thanks for the response and suggestions. :D

My original post was to blow of steam here in the forum and inform people that were interested.
