Louis Makubela pleaded not guilty in the Hillbrow Magistrate's Court on Wednesday to defacing Brett Murray's painting "The Spear".

Dressed in khaki pants and jacket, he also exercised his right to remain silent.

State witnesses Paul Warner and security guard Paul Molesiwa described what they saw on May 22 last year at the Goodman Gallery in Johannesburg.

Warner recounted seeing both Makubela and Barend la Grange smearing paint on the painting, and how he initially tried to stop Makubela from leaving before backing off and using a cable tie to bind La Grange's hands.

He said he backed off from Makubela as he was not the largest man, and Molesiwa apprehended Makubela as he tried to walk out the room.

Warner said he believed both Makubela and La Grange were vandalising the painting at the same time.

Cross-examined by Johan Spangenberg, for Makubela, he was asked to read aloud an affidavit he made on May 22 last year.

His affidavit differed slightly from his testimony regarding how long he had been at the gallery, his distance from the painting, and La Grange and Makubela smearing the painting not simultaneously.

Warner agreed his affidavit was more accurate, given that time had passed since the incident.

Molewisa, who faces charges of assaulting Makubela following the smearing, testified that he had been specifically told to guard the painting when he reported for duty at the gallery at 6am.

When he went to the toilet later on, he was told by a woman that the painting was being smeared.

He went to intervene, and only saw Makubela smear the painting, and not La Grange.

"I saw him [Makubela] alone. If there was someone else, I did not see him," Molesiwa said through an interpreter.

The court took a brief break from the matter to deal with other issues.

La Grange, present in court, has already paid a R1000 fine.

Smeared Painting Accepted by Client

"The Spear" painting by artist Brett Murray was accepted unaltered by a German buyer who paid around R120,000 for the piece, the Hillbrow Magistrate's Court heard on Wednesday.

Alexander Pinero, the logistics manager at the Goodman Gallery where the painting was hanging on May 22 last year when it was allegedly defaced by Louis Mabukela, said the painting was now with the German client.

"We only deliver on payment," Pinero told the court.

"As far as I am aware nothing was done to restore it."

He said he did not see how the painting was damaged, but saw two men being apprehended by security.

Before Pinero testified, police constable Mishack Dihangoone told the court that when he arrived at the gallery, both Barend la Grange, who also stood accused of defacing the painting, and Mabukela had been apprehended by gallery security.

He observed that they both had black paint on their hands.

His colleague arrested Mabukela, but Dihangoone was the officer who charged him.

He said they were originally called to the gallery because something had been spoilt.

"We were called to the Goodman Gallery because there were people that had spoilt something," he said via an interpreter.

Magistrate Mohammed Jajbhay adjourned proceedings until Thursday when the final witness was expected to testify.

Mabukela had the option of paying a R1000 fine like La Grange, who did pay, but he refused.
