I read somewhere, cant remember where... they arent allowed to put traffic cameras on a road that doesnt have the camera logo on it?

Is this true?

The road I saw a camera mounted (temporary) was a road that has a "60" sign but there is no camera little warning thing that they usually put there.

Yah, im not sure where I read that just wondering what the legal requirements are for puttin up a camera Temporary or Perma.

I've also heard it - probably an urban myth - even if its true - like the law cares in SA, its a money stream.

Also has to be level for 100m on either side. We all know how they love trapping on steep down hills

I also heard the rumor, and seen some evidence. They put up a camera nearby and also put up the board about 500m before camera.

There was a temporary camera I was caught at.

Durban Road here in Durbanville if anyone knows... as you go around the bend after the Rose Garden (after Fairmont High School) about 3 robot sets after Fairmont High.

Temp camera was just around the corner of that, but checked today and all the sign posts say 60 but no camera sign.

I was probably going like 78 - 83. Everyone goes that speed on that road though, especially during the day, if you going during the day there then u better be doing 80 else you have car by car passin u.

I swear that should be like a 70 zone logically.

i have also heard that rumour, but then you would need to argue it in court...

...and long before that jmpd would have already locked you in the white van

There might be one further down Durban Road towards Bellville. But I think this is a myth anyway, because almost none of the roads here have camera warning signs.

Notice of speed checking by camera.

Part 29 para4(g):
'Where cameras are used, clear notice of such a fact must be given to users of the road in question."

Source: The National Prosecuting Authority policy manual issued to all public prosecutors containing guidelines and procedures for prosecution of offences. Part 29 deals with speed prosecutions.

Well for how long is a camera warning sign 'valid'? For example, if I drive on a 70km stretch of road and there's a sign at the start, does it count for the whole way?

Can someone confirm the 'level for 100m either side' thing? I know of many camera spots both permanent and roving here in Durban where they are on at least slight declines.

And the one going downhill on the M7 Queensburgh to Edwin Swales? Thats a real sneaky one cos they put it on the bridge over the M7 which according to some is illegal as well.

What about the one in Kloof on the M13? On the footbridge in front of Woolies. No real incline but very sneaky, as you have to do 80 and some people come flying through there.

I've had a goodly amount of fines for speeding.

In many cases where I was doing the crime I've spent the time (paying the fine)

Where I've felt that the location of the trap was unreasonable or that it was set up incorrectly, I have waited for the summons to be served on me.
I then put my plea in writing, comprehensively, and get to see a prosecutor.

I assure you that he'll either withdraw the case or suggest that you write to the Director of Prosecutions for the respective province. I have had a remarkable success rate in that only in one instance has my submission been rejected.

One prosecutor told me that they have much more important cases, and, if they could find the slightest reason to reject the case, that they would do so. They are also motorists and find the uniformed (but ill informed) revenue
collectors a pain in the butt.

AFAIK the camera must not be positioned closer than 300m from the camera road sign.
I think that this rule is only for permanent speed traps. Mobile speed traps can be set up anywhere.

don't think thats true (but i stand to be corrected)
i heard that they arent allowed to trap (mobile camera's) 80 to 100m from a speed sign...so for eg if you see a sign saying 100 and there's a cop behind the sign trapping ...it's illegal ... im pretty sure it's a fact but like i said I stand to be corrected...

There was a whole report about it on 702, they even spent a day with the traffic department due to a whole lot of people complaining about the trapping happening on the N1 and other highways where construction is happening and where temporary yello signage say the limit is 80km/h.

Finds were that speed reducing signs must be 300m apart i.e. A road can't just got from 120 to 80. It has to be sequential. 120, 100, 80.
They also found that speed trapping cameras must be placed at least 300m from the sign, allowing motorists enough time to actually see the sign and slow down sufficiently (which is the whole point innit?).
Another finding was that a sign that doesn't have the camera sign under it means any speed violation fines from that road are null and void.
Temporary cameras have to be on a road that has the right signage...and they must be within 300m of the sign.

But this is all good and nice for us who actually care to know this stuff...we're just a blip in the millions they make from the public. So they'll keep doing the unfair stuff...2 or 3 people might object but like rvonh says, they're more than happy to cancel warrants at the prosecutors off. (heck, I went and paid 3 years worth of tickets and warrants last month...the pulled 80% off the final amount. Don't go in there with a 'i-know-it-all' attitude...you'll never win)
