Speed Trap setup in the emergency lane

This weekend, I noticed a white car parked in the emergency lane just after Empire road offramp on the M1 North.

The car had the boot open. The officer was sitting on the bumper and had setup his speed trapping equipment.

Surely you cannot obstruct the emergency lane for speed trapping?

Is this legal? Are the fines for infringements caught by this person legal (i wasnt speeding)?

It would be legal by definition of the requirements for trapping (level surface), but it's really stupid and quite likely illegal, to block the emergency lane, especially for trapping.

Take down the number plate, photo won't hurt. Go to the police station, lay a formal complaint with the senior officer (when I did this I had to lay the complaint with the commander of the station).

He is legally obligated to open a formal hearing into the matter.

If he chooses not to proceed you can escalate, but with knowing the police in Gauteng, he'll probably get off. Might even be the station commander's idea.

Other option is to lay a charge, given that it is a carriage way it could well be classified as gross negligence. Again tho, they may just give up on the case the minute you file it.

Police aren't too big on doing their job these days. Especially if it gets another police officer in trouble. And most especially if it stands in the way of meeting a ticket quote for the police money making business.

Sadly the people charged with enforcing road rules are usually to poor to afford a car so they have little grasp of the exact details.

You see the same thing with the guys painting the lines and placing the signs...somethings its clear they just don't have any grasp of whats going on at all. (No my car can't do a 90 degree turn on a dime)

Can't stop there the law state's no one is above the law. However it's not so and all those in power think they are.
