Speeding fine - 80km/h on freeway???

Just got a speeding fine letter - I was going 106km/h on the M3 between Constantia Main Rd and Ladies Mile Rd.

The letter says its a 80km/h zone??? :confused:

I always thought the freeway was a 100km/h zone? Did they change it or are they stuffing me around?

How do I contest this?

You sure it really is freeway there?

The 'freeway' around the waterfront has been 60km/h all along for some reason :(

Yip - 100% sure. As you start the M3 (coming down Wynberg hill there's a 100km/h sign)

The only thing I can think of is in the pic there are those white croncrete blocks on the side of the road - so maybe they were building and then it became a 80km/h zone? I don't remember seeing any signs though.

Going to write and contest it.

Ya, I know the stretch you mean. I know it's is slow there but slow as in 100 and not freeway speed. Could have been the construction. But worth a contest. Good luck :)

...as far as I am aware they are not allowed to "trap" you within 300m of a change of speed limit sign, so take a look at the distance from the sign (if there is one) and the point of your photo prior to objecting. I'll try and find the legislation.

Here we go, I found that distance legislation :

GUIDELINES FOR PROSECUTION
WITH REGARD TO SPEED AND TRAFFIC LIGHT PROSECUTIONS


1.1. The provisions in this document are operational guidelines only and non-compliance does not influence the accuracy or reliability of measurement results. The decisions whether or not to prosecute remains in the discretion of the prosecutor.

1.7. No prosecution may be instituted where the speed measurement was taken within 300 metres of the commencement of the speed limit zone, except with permission from the Director of Public Prosecutions

When/what time did u get caught? I drive that road every day. Wonder if mine is in the post. :(

Seems like they've been trapping on the construction sections of the roads quite a lot in the last couple of weeks. Unless those incidents just make it into the news easier - as people are sticking to their usual speeds, making the offences bigger due to the sudden drop in speed limits.

EDIT: They are yellow circular speed limit signs.

The peninsula cops are great at trapping as the speed changes..I spent R750 "slowing" down for a robot on the way down to the Simon's Town main road from Ou Kaapse weg...I have a nasty suspicion that the road you are talking aboy is 80 km/h, however........good luck :(

that stretch is 100km/h, but they are doing construction so its been dropped to 80. However if you remember the jhb N1 fiasco about trapping in construction zones, trapping in these zones is illegal....well as far as i recall.Also they need to display trapping notices/signs in order to trap legally.

Aren't triangular signs warning signs, IOW it would just be a 'recommendation'? To be a real speed limit sign it would have to be a round sign.

Yea, regarding that speed trapping on construction zones.
So far I could figure out, the traffic department have to apply for special permission to trap in the construction zones.

Yeah, I wondered the same thing afterwards and checked the signs out this morning - they are actually the yellow circles with red borders. My bad.

On the way home (heading south) on the same stretch - first the yellow 80km/h signs, then the usual sign stating 100km/h midway through the construction site, then later a yellow 100km/h sign with a sign to denote the end of the construction. That's going to confuse people. :)
