Transnet urged to sue Nedbank

The law firm helping to clean up Transnet has advised it to haul Nedbank to court if necessary to claim back the R1.5 billion it allegedly lost in an “irregular” deal related to the controversial tender to buy 1 064 locomotives.
In its advice to the state-owned logistics company, Mncedisi Ndlovu & Sedumedi (MNS) Attorneys charges that Nedbank and Gupta-linked company Regiments “apparently colluded” to “defraud” Transnet.
This is the latest salvo by Transnet, which has already instituted claims against former employees and companies totalling R1.458 billion related to the R54.5 billion locomotives deal that saw Gupta-linked businesses rake in more than R5 billion in kickbacks. Regiments has already been slapped with a R189 million summons and Trillian Capital Partners with one for R146 million.

PRETORIA - Former Transnet engineer Francis Callard continues leading evidence at the state capture commission of inquiry on Monday.
Evidence presented last week revealed significant irregularities in contracts worth billions of rand.
Callard set out in technical detail why the China South Rail locomotives were not the ideal option for Transnet which needed trains to operate on the coal network.
He had argued that Mitsue was the better option because the company had already delivered products, which had been locally tested, prototyped and drivers had been trained.

Zondo Inquiry told CSR did not meet requirements for Transnet tender

PRETORIA - Former Transnet electrical engineer Francis Callard said the decision by the parastatal to unilaterally change the technical specifications of the locomotives to be procured was extremely irresponsible and undermined the purpose of the acquisition project.
Callard on Monday testified at the state capture commission of inquiry about the irregular procurement of 100 locomotives from China South Rail (CSR) for the coal line.
Callard said decisions related to the multi-billion rand project were taken without input from technical experts.

Transnet bid process for locomotives manipulated, Zondo commission told

PRETORIA – The state capture commission of inquiry has heard how certain costs related to locomotives were disregarded during the bid evaluation process in order to favour a Chinese manufacturer but were slipped in later after the contract was awarded.
Former Transnet engineer Francis Callard testified how the bid process for 1,064 locomotives was manipulated and the offer accepted by Transnet was not a true reflection of the actual cost.

Zondo seeks answers from Hawks over Transnet’s R647m payment to fake supplier

JOHANNESBURG - Deputy Chief Justice Raymond Zondo has ordered his legal team to ask the Hawks why they did nothing when whistle-blowers told them of the R647 million payment Transnet made to a fake supplier, Business Expansion Structured Products (BEX).

“I want to know what’s happening about this and why should it take so long for the matter to be concluded. The legal team can alert the chairperson of Transnet of this evidence that we’ve heard,” Zondo said.

The company secured R5 billion through the deal.

Molefe insisted on awarding IT contract to third bidder T-Systems, Zondo hears

Johannesburg - The state capture inquiry has heard how former Transnet CEO Brian Molefe irregularly rescinded a decision to award an IT contract to telecommunications company Neotel.

Former Transnet employee Gerhard van der Westhuizen told the commission on Monday how Molefe intervened in awarding an IT network management contract to Neotel without any substantial basis and pushed through the appointment of third bidder T-Systems.

Inquiry hears Homix paid R36m despite no involvement in Transnet, Neotel deal

Johannesburg - The Zondo commission has heard how a consultancy firm was paid R36 million for brokering fee yet it did not do any work.

Transnet former employee Gerhard van der Westhuizen took the stand on Monday and told the commission that a consultancy company called Homix was paid millions for brokering a deal between Neotel and Transnet yet it was never involved. .

Former president Jacob Zuma was intimately involved in setting up a television news station with his controversial friends, the Guptas, the state capture commission heard on Monday.

The former editor of the new defunct 24-hour news channel ANN7, Rajesh Sundaram, testified that while Zuma's son, Duduzane Zuma, was also involved in the project, his role was minimal.

The family, and its relationship to Zuma, has been central to allegations of state capture.

“President Zuma was more actively involved on the status of TV project; Duduzane's involvement in setting up of station was minimal, I would say,” said Sundaram.

The expedited visas are interesting, though not news:
“I was told the visa would bypass normal procedure, that our details will be sent to [Gupta lieutenant] Ashu Chawla in SA, who will speak with high commission officials here, direct government departments to expedite visa and bypass some requirements,” Sundaram told the commission.

“To my surprise my visa was cleared quickly in a matter of days. I was not interviewed in any point, nor my colleagues, by the High Commission of SA in New Delhi. The normal procedure was bypassed for these visas.”
