State capture inquiry begins

Wow, i dont reckon he wants to come back, i think Hogan's testimony is credible and well put. It links Zuma directly not through a 3rd party and at that point you could see his attorney call for the end of the day.

Wonder if he will come back tomorrow.

Zuma doesn’t look stressed a bit. Jolly as ever, like he were in parliament. His clouded memory is all prep going into this as a witness. The commission must establish ‘something’ beyond a reasonable doubt to put in a recommendation to have Zuma prosecuted.

Zuma has evaded prosecution. The NPA couldn’t succeed and where is the private prosecution at? I may be pessimistic, but I don’t believe there will be enough ousting to incriminate Zuma and then there is the evidence which only the prosecution will be able to dig up.

I must say, someone with alleged death threats and possible bomb threats didn't mind to attend his daughter's graduation in all exposure and show.

Yeah he will... He can't be seen to bow out under pressure.

He may not look stressed, but I think that is because he doesn't understand what is happening here. He isn't being charged with anything, but everything he says is under oath so can be used as evidence in a court of law.

He understands very well what is happening here, that is why he has a legal team and is prepared in advance. It is still the Zondo Commission which must put in the recommendation to have him prosecuted, and ultimately I believe this task, to decide on, will be given to the president to which the commission must report to once concluded.

He clearly can't understand the under oath bit entirely... He's made some very dangerous statements, and even some of his "I don't know" answers have put him in a problematic position legally.

The last portion was very interesting - when Zuma was asked about whether he knew about Hogan's review of the cabinet approval process of CEO's in period 2002- 2009, Zuma said no. Then his lawyer frantically jumped in to "overrule" his client and ask for adjournment.

My guess is there is evidence that Zuma knows about this review, and him saying he doesn't will make every other time he said he had no knowledge look (more) dubious.

It will all depend on whether the Zondo Commission will be recommending a prosecution, how they report on the investigation. They need to ask the right questions, to receive the ‘right’ answers, in order to conduct a proper cross-examination and that is why Zuma’s legal team is trying to create doubt in the process. Zuma’s legal team is actively challenging the rules governing the proceedings.

Advocate Thabani Masuku, on behalf of Zuma, raised his objections to Advocate Paul Pretorius as the latter was leading the former president through former Government Communication Information System (GCIS) CEO Themba Maseko's evidence.

Maseko told the commission during his testimony last year that Zuma had told the late Collins Chabane, who was minister in the presidency responsible for performance monitoring and evaluation, to make sure Maseko leaves the GCIS after he refused to bow to the Gupta family's instructions.

"We have a duty to raise concerns when we see a development in the manner in which our client is being cross-examined. Essentially what is going on now is that Mr Pretorius is cross-examining Mr Zuma. He's cross-examining him about issues we are not clear about in so far as the terms of reference are concerned.

"As you recall, Mr Zuma has read this affidavit, we have read it. We took the view that it doesn't implicate the [former] president in any of the terms of reference that this commission is about. That is the attitude we took.

"Now of course, in your discretion, you decided that the president should come and give his version of events. What is going now is not Mr Pretorius assisting Mr Zuma to give his version of events, what he's doing, he's cross-examining. Which is not a problem if Mr Zuma's attitude had been that there are aspects in the statement of Mr Maseko that implicate him in fraud, corruption and this state capture."

An agitated Masuku insisted that if the commission wanted to cross-examine Zuma, they should have made it clear.

He questioned how Zuma was expected to recall meetings where he was not present, saying it was "unfair".

After some back and forth with commission chair Deputy Chief Justice Raymond Zondo and the commission's legal team, Zondo requested a meeting with both teams after the tea break to discuss the matter.

The mandate is simple, in regards to Zuma, the commission must establish,

1.2 whether the President had any role in the alleged offers of Cabinet positions to Mr Mcebisi Jonas and Ms Mentor by the Gupta family as alleged;

1.3 whether the appointment of any member of the National Executive, functionary and /or office bearer was disclosed to the Gupta family or any other unauthorised person before such appointments were formally made and /or announced, and if so, whether the President or any member of the National Executive is responsible for such conduct;

1.9 the nature and extent of corruption, if any, in the awarding of contracts and tenders to companies, business entities or organizations by Government Departments, agencies and entities. In particular, whether any member of the National Executive (including the President), public official, functionary of any organ of state influenced the awarding of tenders to benefit themselves, their families or entities in which they held a personal interest;

Zuma (and legal co.) under any above incrimination will wish to be recommended by the commission to a separate enquiry than to be prosecuted under recommendation by the prosecution. At best they will want to walk away.

tomorrow's story today - a suspicious break-in was attempted at no 1 criminal's residence - hence he has been moved to undisclosed location and his lawyer requests indefinite adjournment citing fear for his client's life.

All they can do is to create doubt in the commission's terms and rules should they wish to be evasive.

Regulations shall be made, after consultations with the presiding judge, in terms of the Commissions Act, 1947 and shall apply to the Commission in order to enable the Commission to conduct its work meaningfully and effectively and to facilitate the gathering of evidence by conferring on the Commission powers as necessary, including the power to enter and search premises, secure the attendance of witnesses and compel the production of documents.

A thriller awaits. Will people be back to do hard work of 12600 seconds? Will there be enough tea and lunch breaks to quench thirst and nourish the impoverished stomachs?

It looks like Number 1 gangster's legal team is testing patience of Justice Zondo.

Very much so, and I'm very very surprised at his patience... By this point i would have told the legal team to sit the fsck down and shut up, and I would have told Zuma that "I don't know' is not an acceptable answer, when he can remember shyte from the 80's in detail but can't remember stuff from being the President of SA
