Swapping a cell phone.

Hi,
I want to change a phone that I had on a contract that has now expired, for a different model of phone. I posted an advert on a local site and have had at least six replies so far.
I'm now wondering if there are any legal implications to doing a deal? My phone is mine and now off contract, so no problems there - but what about the other guy's phone? If it's still on a contract can he swap it with someone else or worse still how can I tell if it's been stolen?
Is there any way to check these things out?

Make sure he includes all accessories including manual, that way it's less likely to be stolen. Test the phone by making a quick call.
