Telkom junction box in my back yard

I recently bought a house and discovered that in the back corner of my property is a manhole and in that manhole is a Telkom junction box feeding all my neighbours and probably the whole block with Telkom service. I know this because the contractor that Telkom sent out to activate my adsl told me so. There is currently 2 square meters of space that Telkom is using rent free in my back yard. Thoughts? Does anyone know who I can contact regarding this issue?
 
Well I could cut the junction box out of the ground. Fill the manhole with concrete. But I'm hoping to find a more amicable solution.

I'm pretty sure Telkom would call the police and have you arrested for damage to property.

Whose property would that be then? What i'm looking to find out from you guys is what is legally within reason. Is there some kind of ombudsman I can contact to have the junction moved from my property. Im pretty sure something can be done. Does Telkom have a representative on the forums?
 
Maybe MickeyD can shed some light on this, but I am quite sure that there is some legislation in place that allows Telkom to do this.
 
No I want it removed.

How much are you willing to pay? And that's not for paying Telkom, that's for compensating your neighbours who will be without internet and phones for however long...

Anyway, you are dealing with either a wayleave or an easement (more likely situation), good luck with that.

73.
(1) If a fixed line operator finds it necessary to move any telecommunication facility, pipes, tunnels or tubes constructed upon, in, over, along, across or under any land, railway, street, road, footpath or waterway, owing to any alteration of alignment or level or any other work on the part of any public authority or person, the cost of the alteration or removal shall be borne by that local authority or person.
(2)
(a) Where any telecommunication facility, pipe, tunnel or tube constructed by an operator passes over any private property and interferes with any building about to be erected on that property, the operator shall, on receiving satisfactory proof that a building is actually to be erected, cause the line to be deviated or altered in such manner as will remove all obstacles to building operations.
(b) Notice that any such deviation or alteration is required shall be given to the operator in writing not less than 28 days before the alteration or deviation is to be effected.

(3) If any deviation or alteration of a telecommunication facility, pipe, tunnel or tube constructed by an operator and passing over any private property is desired on any ground other than those contemplated in subsection (2), 28 days' notice thereof in writing shall be served on the operator, who shall decide whether or not the deviation or alteration is possible, necessary or expedient, and if the operator agrees to make the deviation or alteration, the cost thereof shall be borne by the person at whose request the deviation or alteration is effected: Provided that in any case where in the opinion of the operator it is justified, the operator may bear the whole or any part of the said cost.

Your estate agent should have informed you of the junction box.
Whenever your neighbours or yourself experience telecommunication problems chances are good that OpenServe will require access to your property which you cannot refuse.

So my question is how much he is willing to shell out is accurate...

(1) A fixed line operator may, for the purposes of provision of its telecommuni*cations services, enter upon any land, including any street, road, footpath or land reserved for public purposes, and any railway, and construct and maintain a telecommunications facility upon, under, over, along or across any land, street, road, footpath or waterway or any railway, and alter or remove the same, and may for that purpose attach wires, stays or any other kind of support to any building or other structure.
 
The telecommunications act says they are allowed to use what ever property they want to use, nothing you can do about it.
Not nothing...

Property owner has three options.

1. Approach the owner of the facility and ask them if they have any plans to upgrade the facilities in the near future. If yes, then request them to build it elsewhere. In this case the facility owner will bear all the costs.

2. If the property owner wants to build on that specific portion of his/her land, provide the facility owner with the approved plans and they will have to move their facility. Beware of scamming this option... if they come back and check to see the new building work and there is none, they will bill you for the movement of the facility. And it is not cheap.

3. Ask the facility owner to move the facility and be prepared to pay for it.
 
Can you not just right an affidavit saying that there are always people claiming to be from Telkom wanting access to your property, when you ask for identification they get angry and leave. You are worried about the safety of your family and wish for that junction box to be moved else where how ever you cannot afford to fork out the money to
do so.
Its a lie however its also unfair to you that Telkom can just use your property for free and generate an income plus add a security risk to you and your family.

I am also sure that somewhere there is some sort of human right being infringed on. That's my two cents worth of advice.
