Tenant can't pay rent

Start the eviction process. If things are already so bad in your tenants industry, it is not going to magically come right in May. Just like this virus isn't going to just disappear by next Month.

Or do you mean split remainder over rest of the lease and then wait until after April to see how things work out before starting eviction proceedings?

Its truly all you can do, but get an agreement in writing now. You will have to decide what to do in May, June...
 
If you are happy with the tenant and they have paid faithfully up to now, I don't see a reason for them to lie. I do find it a bit arrogant to tell you to apply for a payment holiday, although I guess they are desperate.

I would consider to ask them reduced rent so you can cover the basic levies, put it on paper that it will only be for the one month and does not cancel out their contract.

The other option is to make use of the deposit they paid to make up for the amount that will be unpaid.

I am just trying to put myself in their shoes.


The import part is to make sure everything is in writing and signed.
 
All those who say you must evict them based on a world wide pandemic and crises. I hope you get the same treatment when the time comes. None of us! NONE! Could have predicted or prepared for a time like this.

Will there be chance takers, sure, but you would have noticed issues before already.

If my wife and I don't get an income this month, there is no way I will be able to pay my rent. I will be completely at the mercy of my landlord.

But I will expect there to be a payment arrangement afterwords and everything on paper.
 
I would ask the for 3 months bank statement and proof that they applied to uif or those programs.

If they can’t pay fine but they need to show proof. I guess you can start the blacklisting process or negotiate with the tenant. Depends on your perspective.

Maybe delay on the eviction process though

Credit rating is the ability to pay off your debts. One can argued if you can’t pay off your debt because you didn’t get paid for the month or got retrenched should be reflected in your credit score. Since a high credit score should entails having about 6 month worth of your salary saving as an emergency. I guess it just depends on your view.
 

Probably the physical eviction yes, but I'm sure one can get the ball rolling on paperwork etc so long.

Having said that its not a great situation to be in - Can they pay SOME rent at all?

Not sure yet. Will get in contact with them soon, first wanted to see what the feedback/suggestions are.
 
Received the same request today. My tenant has been renting from me for 8 years. He's self employed in the building sector and work has definitely dried up. He has paid April's rent but just letting me know he doesn't think that he'll make next month's rent.

I told him we can work out something as long as my costs are covered. I have requested a payment holiday from the bank but not sure municipality will do the same for rates and water. Body Corp already said levies must be paid.

No point in being a dick about something that is impacting every sector of the economy. Rather have less rent for 3 months with a reliable tenant that will make up the shortfall over the next 12 months.
 
From a renters point of view, I had to issue out a request to my Agent to discuss a rent reduction for my side. Our offices just let go of about 20% of the staff. The remaining lot had to take a 15% salary cut. Doesn't sound like a lot, until you really look a the budget. Things are definitely going to be much tighter, so we need to buckle down to weather the storm. I've asked for any sort of reduction based on the unique situation. (This is the first time that I've ever had a salary cut) If they are unable to help out then I would need to look for new property that is better suited to my new budget. My lease is up in about 3 months, so it may just come down to the lease not being renewed anyway.
 
I get the feeling they are taking advantage of the lock down. Your bond and payment holiday has fckall to do with them.

Absolutely. And what if you don't get a salary either for the foreseeable future.
 
Things are going to get hard from here on. Already got requests from owners how can only pay 30% of levies (from this month).

If anyone is a landlord, look at the history for starters, work something out (that is how I see it).

A payment holiday is only (you wont be reported to collectors etc). But things add up too

Very hard move, do you give the person some slack ? What if next month also the same story ?

I have a tenant the benefit for 3 months and called it a day at the end.
 
This is a very difficult scenario. But, how are you going to evict anyone? How would you get new tenants? It's not like you can have a viewing on your property.

You should have a deposit that you can utilise. At least for the official 21 day period at the moment.
