Brits - Four men accused of the murder of two women from Mooinooi in the North West province appeared briefly in the Brits Magistrate's Court on Friday.

Their case was postponed to January 5 to verify the age of one of the accused who claims he is a minor. According to the charge sheet he is 18-years-old. The court also wanted officers to verify whether two of the other accused were legally in the country. They are Mozambican nationals.

Aaron Sithole, 23, the teenager, and Koos Strydom, 53, were arrested in Majakaneng near Mooinooi on December 14. Alex Mudau was arrested a day later, also in Majakaneng.

The four are facing two counts of murder, kidnapping, robbery, unlawful possession of a firearm and defeating the ends of justice.

7 in court for murder of Mooinooi couple

Pretoria – The six men and a woman accused of the rape and murder of Mooinooi couple Anisha and Joey Van Niekerk in December remain in custody following their court appearance on Wednesday morning, North West police said.

This as police continued the search for a 21-year-old woman, the alleged girlfriend of one of the suspects, for questioning in connection with the murders.

Joey, 32, and Anisha, 30, were last seen alive when they left their smallholding near Mooinooi, roughly 40km from Rustenburg, for a funeral in Pretoria on December 10.

Their vehicle was found burnt-out six days later in the Magaliesburg area.

Police spokesperson Mpeile Talane told News24 that the Brits Magistrate's Court postponed the case against the suspects for further investigation.

They cannot be named as a rape charge was added and the accused have not yet pleaded.

Bail application postponed

Talane said DNA tests still needed to be concluded to determine whether bones discovered in bushes near Buffelsfontein on January 2 were those of the couple.

He could not elaborate on why the couple was suspected to have been raped.

"The matter is now sub judice."

Meanwhile, Netwerk24 reported that the seven face charges of murder, rape, robbery with aggravating circumstances and possession of illegal firearms.

The suspects were set to apply for bail, but this was postponed because two of them only secured legal representation on Wednesday morning.

It is alleged that the couple was killed after they refused to sell their property in Mooinooi.

The suspects are set to return to the Brits Magistrate's Court on January 15.

Six men and a woman have been arrested and have appeared in the Brits Magistrate’s Court last Friday.

Aaron Sithole (23), Alex Mudau (36), Moses Rakubu (33), Koos Strydom (53), Vincent Strydom (29), Maruschka Opperman (18) and Jack Mokotedi (18) appeared in court on charges of murder, kidnapping, robbery, rape, the illegal possession of a firearm and obstruction of justice.

Koos Strydom, a panelbeater, had a workshop on the two women’s property and allegedly wanted to buy the property.

His son Vincent and his girlfriend, Maruschka, are also suspects in the case.

According to Wynand, the panelbeater wanted to buy the women’s smallholding, but Anisha did not want to sell.

The day after Anisha and Joey disappeared, the panelbeater allegedly told him that the transaction had been completed and that he had paid with a bag of money.

Joey and Anisha disappeared on 10 December from their home in Mooinooi.
 

The theory is:

Panel-beater owned the land next to theirs. He wanted to buy the land from the 2 ladies but they refused to sell. So Murder was committed and then the Panel-beater claims to have concluded the deal with them before they got murdered. In the Panel-beating shop they found evidence of someone practicing their signatures in a book.

The charges of the six men and two women include kidnapping‚ rape‚ house break-in‚ murder and robbery with aggravated circumstances. According to the Criminal Procedure Act‚ the suspects in a sexual assault case may not be identified until they have pleaded.

Joey and Anisha van Niekerk‚ a married same sex couple‚ disappeared from their smallholding outside Mooinooi on December 10 last year. It was on the eve of a funeral of Joey’s father‚ which they were set to attend in Pretoria. They never arrived. Their burnt-out car was found on December 16 in the Magaliesburg area. DNA tests are being conducted on bones discovered in bushes to establish if it is the two women's remains.

Alleged mastermind of Mooinooi murder was ‘good friends’ with couple


The man considered to be the mastermind behind the murder of a couple from Mooinooi in North West said he was “good friends” with the couple and they had a “very good relationship”.

“They always came to visit me at the shop‚” the second accused testified on Thursday.

“I also helped them with their horses.”

He said he could not think of a possible motive for their murder.

The 52-year-old owner of a panel beating business appeared in the Brits Magistrate’s Court. He is one of eight suspects whose bail applications started on Thursday.

Pontsho Raikane led the second accused in his testimony who‚ like the first accused‚ claimed the police tortured and assaulted him to extract a confession.
The second accused testified he had repeatedly tried to lay a complaint with the station commander and the Independent Police Investigative Directorate (IPID) after the assault‚ but it had fallen on deaf ears.

The man – who cannot be named until he has pleaded as this is a sexual offenses case – is one of eight people accused of the murder of Joey and Anisha van Niekerk‚ a married same sex couple‚ who disappeared from their smallholding outside Mooinooi on December 10 last year.

It was on the eve of the funeral of Joey’s father‚ which they were set to attend in Pretoria – but they never arrived. Their burnt-out car was found on December 16 in the Magaliesburg area. DNA tests are being conducted on bones discovered in bushes to establish if the bodies belong to the two women.

The charges against the six men and two women include kidnapping‚ rape‚ house break-in‚ murder and robbery with aggravated circumstances.

In court on Friday‚ accused number two‚ made the startling admission that he didn’t know the identify of the victim in the case he was being tried on.

“Sir‚ is Anisha connected to this case?” state prosecutor Christine Molautsi asked him. “Anisha? Is it this case?” the second accused asked. “Yes‚ sir‚” Molautsi replied.

Mooinooi murder: 'Continued incarceration will cost me child'

Brits - A Mooinooi man, accused of murder, told the Brits Magistrate's Court on Friday, that his continued incarceration will lead to him losing his child.

"I am paying maintenance to my child, if I am kept in custody, I will no longer be able to pay maintenance and I will lose my child for good," Vincent Strydom told the court during his bail application.

He said he was employed at his father, Koos Strydom's panel beating business and earns R6,000 per month, from that he pays R500 each month to his six-year-old child.

Vincent together with his father, his girlfriend, his father's wife and four other men are allegedly involved in the disappearance of a same sex couple in December.

The State alleges that Aaron Sithole, 23, Koos Strydom, 53, Jack Mokotedi, 18, Alex Mudau, 36, Moses Rakubu, 33, Vincent Strydom, 29, Maruschka Opperman, 18 and Mercia Witney van Rooi, 21, kidnapped, robbed and killed Joey van Niekerk, 32, and Gesina Sophia Anisha van Niekerk, 30, of Mooinooi.

The same sex married couple went missing on December 10, they left for a funeral in Pretoria but never arrived. Their car was found burnt on December 16 in the Magaliesburg area.

He denied the charges against him and intend to plead not guilty.

Mooinooi murder accused 'beaten every day for a week'

Brits - One of the eight people accused of the murder of a couple in Mooinooi, was beaten for a week to such an extent that his body was swollen, the Brits Magistrate's Court heard on Friday.

"I was beaten every day for a week, my body was swollen and I could not even wake up or wash my body," Jack Sithole told the court.

He was testifying in his opposed bail application.

The State alleges that Aaron Sithole, 23, Koos Strydom, 53, Jack Sithole, 18, Alex Mudau, 36, Moses Rakubu, 33, Vincent Strydom, 29, Maroela Opperman, 18 and Marchia Strydom, 21, kidnapped, robbed and killed Joey van Niekerk, 32, and Anisha van Niekerk, 30, of Mooinooi.

They are facing two counts of conspiracy to murder, two counts of kidnapping, two counts of rape, robbery with aggravating circumstance and two counts of murder.

North West women hanged and bodies thrown in dustbins

Colonel Isaac Tlhape testified in the bail application of the eight accused that the Mooinooi women Joey (32) and Anisha (30) van Niekerk were taken to the farm by one of the accused where some of the other accused were waiting for them, Kormorant reports.

He told the court that one of the women was taken inside the house and raped by one while the 21-year-old wife of the ‘mastermind’ watched.

“The two victims were then taken to a container and tied up,” he said.

According to Tlhape the 18-year-old accused in the case raped the women again.

The ‘mastermind’ gave another accused a contract with the order that he had to “make them sign.”
