Good day ladies and gentleman,

First of all my first post on this forum.

This is regarding a third party claim (car insurance). I am pretty sure that threads had been open for more or less the same question I will be asking.
To put it mildly I am fed up being pushed in circles as to where I must lodge my claim, first my insurance company tells me that I should claim from that insurance company and then that insurance company says I should claim from that one. I know that they are trying to shift blame and probably the only reasonable thing would be if there were any witnesses that weren’t involved in the accident to make a statement.
A few months ago I was involved in an accident (car is insured third party). To make it easier I will label the cars involved as follows: A – Truck, B – Car and C – Me

In the sketch I have drawn up is more or less what happened.
( C ) was waiting to turn left on to main road (highway) I was second in the line. (B) was waiting for oncoming traffic so that he could turn in to the lane opposite to where my vehicle was. (A) did not slow down or indicate that he would not be able to stop in time, yet he was more than 50m (roughly guessing) from robot when (B) turned. As the robot turned green for us, the vehicle in front of me (C) turned left and (B) turned right in hope that (A) would stop, this did not happen and (A) collided with (B). (B) Then spun out and hit my car (C) which at that stage was stationary.

After going through hell to find out what I should do I haven’t had any luck as of yet. The insurance company for (A) claims that the robot was amber, I guess in modern lawless South Africa if you approach a robot that is amber you should speed up as fast as you can to see if you can make it. As far as I am concerned (A) is in the blame for what happened and therefore my claim should be from them and not from (B), (B) in return agrees with me as does my insurance company. Yet when questioned (A) holds strong by their story that the robot was amber and I should claim from (B) whom they say is at fault.
This is sending me in circles, I have been at it for more than three months now without any success.
What actions can I take?

Insist that your insurance handle the matter.

Your insurance should handle your repairs.
Then, once that is sorted, your insurance should claim from them (be it A or B)

That is what you pay your insurance for. Let them earn their fee.
They will probably ask you for an excess to do your repair. Later once they have reclaimed your money, from the guilty party(ies) your insurance should refund you.

Seems like OP only has third party and his insurance therefore will not help him too much other than saying who he should claim from

They should still offer him assistance or step by step guidance. It is in their best interest, else the other parties can claim from the OP.

If his insurance advises him to claim from A's insurance then he must request their forms, get 3 claims from reputable repair places.
If he receives no response then go to the insurance ombudsman.

They SHOULD but unfortunately (a friend had experience) they usually turn around and say this is who you must claim from and offer no further help... Your advice is sound though and that is how I'd go about it :)

Guys thanks for the rapid responses I really appreciate the advice that's been given
