Good day all I recently received a very hefty traffic fine where instead of paying the fine I'll have to appear in court, now upon further inspection of the fine it fine it indicates that I was caught at around 11am (when I'm at work) whereas I know I got caught during around 8am , there any way to use this error to get this thrown out of court? Thank you for your patience in reading and for any help advice on the matter

2 Points of advice:
1) Join the JPSA (Justice Project of SA) - they deal with traffic issues such as this [or join Legal Wise, Scorpion etc.]
2) DO NOT go to court or query at the court in person - you'll end signing a form and paying a 'smallish' fine and end up with a criminal record (the form is an admission of guilt).

Now to the fun bits.

The court may legally amend certain administrative inaccuracies (such as wrong spelling, old street names etc.) in official documents, even certain critical pieces of info may be changed or rectified if deemed fair in the course of justice (or something to that matter...).
A time stamp, or incorrectly taken photo could be contested however.

Any discrepancy that could bring the accuracy of the equipment used into question can be a cause for the fine to be withdrawn. Basically a case of "how can you be sure I went over the limit if the machine isn't lekker?"

There is a snag though... the time stamp could be of when the photo was processed of downloaded...

{On a side note: I still have a ticket against me for flying over 140kph in a 80 zone... it's been over 18months since it was issued. Went to an attorney, advised me to keep an eye on the order at Aarto's website. Told me to make sure to act by phoning the court should an Order of Execution be issued.}

I don't know - this is the same crowd that cries foul when Oscar gets a light sentence and foul again when Dewani gets off......and yet.....we now have "Hi guys, can I use a wrong time stamp to get off a fine, where I know I was wrong in the first place"............

But, hey, it's SA - if you can get away with murder, you can get away with a speeding fine...............just don't bitch and moan about our corrupt and incompetent justice system in future. :rolleyes:

Pretty surprised at the lack of forumites chiming from atop their high horses 'you did the crime, now do the time' or pay the fine :rolleyes:
