I got an sms just now notifying me of an infringement and that I could pay on JMPD's site, so I headed over there and was rather alarmed at what is, to be honest, a staggering number of outstanding fines. I've skimmed through some and they're all legitimate - evidently I've been receiving two or three fines every month for the last 3 years on my way to work by doing between 70 and 80 in a 60 zone on Barry Hertzog.

The thing is, I've never received any of these fines in the post or by registered mail. I have got fines by registered mail before, and I paid those. This was a while ago though. In the meantime I've moved houses and it seems that the fines on the site date back to around that time. However, I bought a new car early last year, so even if my previous car didn't have the correct postal address captured (and I'm pretty sure I phoned them to update this when I moved) my current car definitely does.

I accept that I've obviously earned the fines, but at the same time, it would only have taken two or three to make me adjust my driving habits, especially if I knew how regularly I'd be trapped.

So my question is, how is the validity of these fines impacted by the fact that I've never been aware of them till now and who should I contact to help deal with this?

This looks lie a pretty useful site:http://www.aartofacts.co.za/ssm.asp

Any info would be very much appreciated right now.

Thanks.

Same thing happened to me a few weeks ago. Had about R5000 worth of fines that I had no idea about :wtf:

I got a few as well. But i haven't payed them yet. I read somewhere (i think the aarto website) that these fines are not legal. All fines have to be sent via registered mail and the JMPD chose to cheap out in stead. I never got any fine in the post, just got told at a roadblock that i had two outstanding fines from the beginning of 2009. Took them to the police station and post office and they wouldn't allow me to pay for them there. So i still have 2 unpaid fines i guess.

Google it. If they weren't sent via registered mail, they aren't legal. I think. I hope...

Thanks. Thing is between JMPD, eNatis and the Post Office, I have no idea where the mix-up comes in. My address must be wrong on their systems and I haven't thought to check. I've googled it a bit, but can't really find clear information about this whole non-receipt thing, and I have no idea whether there is a pile of uncollected fines lying around for me somewhere..

You don't have to pay it. If you do not receive notice of the fine within 40 days it's not legal. Right now they send all fines under R750 (somewhere there about) through regular post. You can get them all squashed - just claim that you receive them all after 2 months from date of issue or never at all.

This is only valid for Gauteng, not sure of the other provinces.
P.S Do not let them know if your details are incorrect, because this would put you at fault and most likely you'll have to pay up.

This is valid for all other provinces as well under the Road Traffic Act if I remember. The act details as similar clause, saying that you need to be notified of the infringement within 40 day of the date of the infringement.

Hmm, thanks for the info guys. That sounds pretty reassuring. Gotta deal with this asap...

Bump - what happened - did you have to pay in the end?
