Traffic Incident Advice

Just looking for some advice on an incident that happened on the way home from work today. Basically a woman ran full tilt in front of my car from the other side of the road... I was going about 20km an hour pulling up behind a row of cars at the traffic lights, she ran across the far side of the road when she saw a gap, weaved through the stopped row of traffic to my right and all I got to see was her come running out from behind a car in the outside lane and straight into mine where she promptly got knocked off her feet.

She was shaken up but ok, got her to her feet etc, but she did damage to the bonnet of my 1 month old civic as well as the front side panel. Nothing too major but some pretty big gouges out the paint from the martial arts sword she was carrying, managed to push the rest out.

I have got her details and I am going to go get a case number, what recourse do I have ? I would assume I can get it fixed for less than my excess. Can I get her to pay my excess or pay for repairs ?

I might have just let it go, but the aftermath was not pretty, martial arts people threatening my life repeatedly in front of their training center. I therefore want to follow this up as far as possible.

I doubt you'll get anywhere trying to pursue this. Pedestrians seem to get preference because they are more vulnerable :/
 
the pedestrian is always in the right.even if someone tries to kill themself by jumping off a bridge and landing on your car, its you the driver who is responsible.

As my father always said to me "Motor vehicles are like weapons, if you shoot a person in the shooting range, you're still ultimately responsible"
 
Dude, she has a sword. Just move along and count yourself lucky there where witnesses.

Training sword I assume. Hardly can be considered very good at martial arts if she cannot comprehend observation/ballistics.

She knew straight away it was entirely her doing. Her forward speed into my car was far greater than the speed my car was going, I was idling up to a set of traffic lights. She gave about 1m worth of stopping distance from the time I saw her coming out from behind a car in the lane next to me.

Ive gone and filled in a police report. The whole thing would have been far less serious if her martial arts buddies hadnt come out of their training center and threatened to kill me. All I did was stop, check she was ok, take her and her stuff to the side of the road, give her a few minutes to recover and politely ask for her contact details.

Its just so ****ed up that I did everything I was supposed to and at the end of the day, best case scenario is I get to pay R2k excess.

Seriously though, how much of an idiot can you be? Robots have white lines in front of them for a reason - you cross where you are in front of the cars and they can all see you, walking briskly.

Her martial arts buddies getting involved is also pathetic, but I suppose one feels the need to stick up for your friends even if they are wrong.
